`
`REMARKS
`
`Upon entry of the present amendment, claims 29, 30, 48-?6, and "ES-79 will be pending.
`
`Claim 77 is currently canceled. Claims 29, 64, 69, and 75 are currently amended. No new
`
`matter has been added. Reconsideration of the application is requested in view of the following
`
`remarks.
`
`Electiom’Restrictions
`
`In the Office Action, the Office alleges as follows:
`
`1.
`
`The Applicant responded on 81'062'12 to the Requirement for Restrictionl'Election, the
`
`Applicant Elected Without traverse of claims 29-30 and Species of Figures 2-7, as explained
`
`on the July 31, 2013 interview, the feature of the invention “wherein the shape of the base of
`
`the liner when the liner is in a non-collapsed state renders the liner incapable of standing on
`
`its base. unsupported, outside the receptacle” does not read on the elected Species of
`
`Figures 2—7.
`
`Applicants respectfully submit that this issue is now moot in view of the current
`
`amendment, whereby the claims are no longer limited by this feature.
`
`In any event, the present
`
`claims fall within the elected species of Figures 2-7.
`
`Drawings
`
`In the Office Action dated August 16, 2013, the drawings were objected to as allegedly
`
`failing to comply with 37 CFR § 1.83(a). The Patent Office alleges:
`
`2.
`
`The drawings are objected to under 37 CFR 1.83(a). The drawings must show every
`
`feature of the invention specified in the claims. Therefore. the feature of the invention
`
`“wherein the shape 01 the base oi the liner when the liner is in a non—collapsed state renders
`
`the liner incapable of standing on its base, unsupported. outside the receptacle" must be
`
`shown or the featurels) canceled from the claim(s}. No new matter should be entered.
`
`Applicants respectfully submit that this objection is now moot in view of the current
`
`amendment, whereby the claims are no longer limited by this feature.

`
`§ 102 Rejections
`
`Claims 29, 48-53, 55-59, and 75-79 are rejected under 35 USC § 102(b) as being
`
`anticipated by Kaltenbach. Reconsideration of the rejection is requested because Kaltenbach fails
`
`to disclose providing a liner having an open end, a base, and a rim at
`
`its open end that
`
`corresponds in shape to an open top end of a receptacle, wherein the liner is self-supporting, as
`
`in claims 29 and 75, from which the remaining rejected claims depend.
`
`Applicants respectfully note that the text of the present rejection is identical to the text of
`
`the rejection in the Office Action dated August 31, 2012, which was withdrawn in response to
`
`Applicants” response filed on December 21, 2012. Therefore, Applicants hereby incorporate the
`
`remarks from the December 21, 2012 response and respectfiJlly request that the rejection be
`
`withdrawn for at least the same reasons.
`
`The rejection of claims 29, 48-53, 55-59, and 75-79 under 35 USC § l02(b) as being
`
`anticipated by Kaltcnbach is unwarranted and should be withdrawn.
`
`§ 103 Rejections
`
`Claims 30, 54, and 60-24 are rejected under 35 USC § 103(a) as being unpatentable over
`
`Kaltenbach in View of Terrels. Reconsideration of the rejection is requested because Kaltenbach
`
`and Terrels, whether viewed alone or in any proper combination, fail to disclose, teach, or suggest
`
`providing a liner having an open end, a base, and a rim at its open end that corresponds in shape
`
`to an open top end ofa receptacle, wherein the liner is self-supporting, as in claims 29, 62, and
`
`69, from which the remaining rejected claims depend.
`
`Applicants respectfully note that the text of the present rejection is identical to the text of
`
`the rejection in the Office Action dated August 31, 2012, which was withdrawn in response to
`
`Applicants” response filed on December 21, 2012. Therefore, Applicants hereby incorporate the
`
`remarks from the December 2 l , 2012 response and respeetfiJlly request that the rejection be
`
`withdrawn for at least the same reasons.
`
`The rejection of claims 30, 54, and 60-74 under 35 USC § 103(a) as being unpatentable
`
`over Kaltenbaeh in View of Terrels is unwarranted and should be withdrawn.
