`No substance has changed. However, this paper corrects a formatting error in which the

`Claims 1, 3-12, and 14-22 remain in this application. Claims 2 and 13 have been

`canceled. Claims 21 and 22 add more detailed explanations of the function of the display
`
`controller, which is found in the Specification at page 8, lines 14-17.
`
`Claim 1, as amended, overcomes the 35 U.S.C. 102(e) rejection because it has
`
`been amended to include the invention having a colored display to delineate which speed
`
`readings are in violation of the speed limit at a vehicle's current location, a speedometer
`
`integrally attached to the colored display, and a display controller connected to the
`
`colored display, wherein the display controller adjusts the colored display independently
`
`of the speedometer to continuously update the delineation of which speed readings are in
`
`violation of the speed limit at a vehicle's present location. Support for the amendment to
`
`specify that a colored display delineates which speed readings are in violation of the
`
`speed limit at a vehicle's current location is found in the Specification at claim 2, p. 9,
`
`lines 6-9 and in Figs. 1-4. Support for the amendment to specify that the speedometer is
`
`integrally attached to the colored display is found in the Specification at p. 7, lines 28-30,

`p. 8, lines 21-23, and in Figs. 1, 3, and 4. Support for the amendment to specify that a

`display controller is connected to the colored display, wherein the display controller
`

`present location is found in the Specification at p. 8, lines 14-17 and in Fig. 2. The cited

`Awada (6,515,596) lacks a speedometer integrally attached to the speed limit display
`
`(column 2, lines 40-42 and Figs. 1 and 4-6). The vehicle's driver is forced to look in two
`
`separate locations and then mentally compare the speed limit with his vehicle's speed to
`
`determine how close he is to speeding if he is not already doing so sufficiently to activate
`
`the light and/or tone. This significant complexity could be distracting to the driver,
`
`thereby increasing the risk of an accident. In contrast, the present invention provides an
`
`integrated display allowing the driver to immediately ascertain both his speed and its
`
`relation to the prevailing speed limit. Furthermore, the display of the present invention is

`segmentation filter plate that is fixed in position (column 2, lines 31-32) and an

`interrupter plate that rotates in conjunction with the speedometer needle axis (column 2,
`
`lines 35-38). In contrast, the colored display of the present invention adjusts
`
`independently of the speedometer by rotation of a colored filter by the display controller
`
`(page 8, lines 14-1 7).
`
`In addition, the display of Smith, Jr. has a fixed set of speeds at
`
`which the vehicle's driver is warned (column 2, lines 20-25) that have no reference to the
`
`speed limit then prevailing at the vehicle's location and that are limited to the vehicle's
`
`speed (column 2, lines 35-38). In contrast, the present invention continuously updates the
`
`visual warnings provided to the driver regarding the prevailing speed limit in response to
`
`the vehicle's location regardless of the vehicle's speed. The dependent claims 3-10 add
`
`additional novel features to the independent claims recited above and thus are submitted
`
`to be a-fortiori, patentable.

`8, lines 14-17 and in Figs. 1-4. The cited Awada (6,5 15,596) lacks a speedometer
`
`integrally attached to the speed limit display (column 2, lines 40-42 and Figs. 1 and 4-6).

`Additional reasons militate in favor of unobviousness for claims 1, 11, and 20 as
`
`amended, such as unsuggested combination. Specifically, the amended claims recite a
`
`colored display to delineate which speed readings are in violation of the speed limit at a
`
`vehicle's current location, a speedometer integrally attached to the colored display, and a
`
`display controller connected to the colored display, wherein the display controller adjusts
`
`the colored display independently of the speedometer to continuously update the
`
`delineation of which speed readings are in violation of the speed limit at a vehicle's
`
`present location. The cited and relied upon Awada does not have a speedometer
`
`integrated with the speed limit display (column 2, lines 40-42 and Figures 1 and 4-6).
`
`Awada does not disclose or suggest a speedometer integrally attached to the colored
`
`display. The need for the prior art references themselves to suggest that they can be
`
`combined is well known.
`
`In regard to claims 1, 11, and 20 as amended, the combination of a colored
`
`display to delineate which speed readings are in violation of the speed limit at a vehicle's
`
`current location, a speedometer integrally attached to the colored display, and a display
`
`controller connected to the colored display, wherein the display controller adjusts the
`
`colored display independently ofthe speedometer to continuously update the delineation
`
`of which speed readings are in violation of the speed limit at a vehicle's present location
`
`was unsuggested among the prior art references. The need for the prior art references
`

`themselves to suggest that they can be combined is well known. E.g., as stated in In re
`
`Sernaker, 217 U.S.P.Q. 1, 6 (CAFC 1983):
`
`“[P]rior art references in combination do not make an
`
`invention obvious unless something in the prior art
`
`references would suggest the advantage to be derived
`
`from combining their teachings.”
`
`The suggestion to combine the references should come from the prior art, rather
`
`than from applicant. As was forcefully stated in Orthopedic Equipment Co. Inc. V.
`
`United States, 217 U.S.P.Q. 193, 199 (CAFC 1983):
`
`“It is wrong to use the patent in suit [here the patent
`
`application] as a guide through the maze of prior art
`
`references, combining the right references in the right
`
`way to achieve the result of the claims in suit [here the
`
`claims at issue]. Monday morning quarterbacking is quite
`
`improper when resolving the question of nonobviousness
`
`in a court oflaw [here the PTO].”
`
`In the present case, there is no suggestion in the references themselves that they
`
`can be combined. Thus, the applicant submits that any combination of Awada and Smith,
`
`Jr. is an improper one, absent any showing in the references themselves that they can or
`
`should be combined.
`
`As was fiarther stated in Uniroyal, Inc. v. Rudldn-Wiley Corp, 5 U.S.P.Q. 2d
`
`1434 (C.A.F.C 1988), “[w]here prior-art references require selective combination by the
`
`court to render obvious a subsequent invention, there must be some reason for the
`
`combination other than the hindsight gleaned from the invention itse1f.. ..Something in
`

`the prior art must suggest the desirability and thus the obviousness of making the
`
`combination.”
`
`The dependent claims 3-10, 12, 14-19, and 21-22 add additional novel features to
`
`the independent claims recited above and thus are submitted to be a-fortiori, patentable.
`
`Claim 3 recites the colored display being a liquid crystal display. Claim 4 recites the
`
`colored display being a colored filter. Claim 5 recites the speedometer comprising a
`
`needle, an axle having opposing ends with one end attached to the needle, and a
`
`speedometer cable having opposing ends with one end attached to the axle. Claim 6
`
`recites the speedometer further comprising a back plate, a plurality of speed denoting
`
`markings affixed to the back plate, and a housing enclosing the back plate. Claim 7
`
`recites the speedometer comprising a liquid crystal display. Claim 8 adds an electrically
`
`conductive wire having opposing ends with one end connected to the display controller
`
`and a speed limit locating device connected to the opposing end of the wire. Claim 9
`
`recites the speed limit locating device comprising a global positioning receiver and a
`
`database of locations and their corresponding speed limits which is accessible by the
`
`display controller. Claim 10 recites the display controller further comprising a tone
`
`generator. Claim 12 recites the global positioning system receiver further comprising a
`
`database of locations and their corresponding speed limits. Claim 14 recites the colored
`
`display being a liquid crystal display. Claim 15 recites the colored display being a
`
`colored filter. Claim 16 recites the speedometer comprising a needle, an axle having
`
`opposing ends with one end attached to the needle, and a speedometer cable having
`
`opposing ends with one end attached to the axle. Claim 17 recites the speedometer
`
`further comprising a back plate, a plurality of speed denoting markings affixed to the
`
`back plate, and a housing enclosing the back plate. Claim 18 recites the speedometer
`
`comprising a liquid crystal display. Claim 19 recites the display controller further
`
`comprising a tone generator. Claim 21 adds the display controller rotating the colored
`
`filter independently of the speedometer to continuously update the delineation of which
`
`speed readings are in violation of the speed limit at a vehicle's present location. Claim 22
`
`adds the display controller adjusting the liquid crystal display independently of the
`

`In View of the above, it is respectfully submitted that:
`
`Claims 1, 3-12, and 14-22, as amended, recite distinctions that are of patentable
`
`merit under 35 U.S.C. 102(e) and 35 U.S.C. 103(a) for the independent claims and thus
`
`for each dependent claim as well. Specifically, a colored display to delineate which
`
`speed readings are in violation of the speed limit at a vehicle's current location, a
`
`speedometer integrally attached to the colored display, and a display controller connected
`
`to the colored display, wherein the display controller adjusts the colored display
`
`independently of the speedometer to continuously update the delineation of which speed
`
`readings are in violation of the speed limit at a vehicle's present location was unsuggested
`
`among the prior art references.
