`I, John F. Presper, declare as follows:

`1. I am an attorney with the law firm of Oblon, McClelland, Maier & Neustadt,

`L.L.P., counsel of record for BlackBerry Corp. (“BlackBerry”). I am over the age
`
`of twenty-one years, have never been convicted of a crime of moral turpitude and
`
`am competent to give this declaration. I am a member in good standing of the bars
`
`of Connecticut, New York, and the District of Columbia, and am admitted to
`
`Practice before the United States Patent and Trademark Office (Reg. No. 53,483).
`
`I make this declaration based upon personal knowledge.

`2. This declaration is submitted in connection with BlackBerry’s Notice of
