`
`Case IPR2015-01034
`Patent 8,863,979 B2
`
`
`An initial conference call in inter partes review IPR2015-01034 was
`held on September 28, 2015, between David D’Ascenzo, Steven Wilker, and
`Jon Stride, counsel for Petitioner; David Moreland and Jessica Keesee,
`counsel for Patent Owner; Stephanie Chu, in-house counsel for Patent
`Owner, Ignite USA, LLC; and Administrative Patent Judges Wieker,
`Medley, and Barrett. The purpose of the call was to discuss proposed
`changes to the Scheduling Order (Paper 16) and any motions that the parties
`intend to file.
`Counsel for Petitioner and counsel for Patent Owner each represented
`that they do not anticipate any problems with any date set forth in the
`Scheduling Order, and that Lead Counsel would be available to attend an
`oral hearing on May 9, 2016, the date set forth in the Scheduling Order.
`Counsel for Petitioner and counsel for Patent Owner each confirmed
`that they did not file a proposed motions list prior to the initial conference
`call and represented that, at this time, they do not anticipate filing any
`motions. Counsel for Patent Owner was reminded that if Patent Owner
`intends to file a motion to amend, they must arrange for a conference call
`with the Board prior to filing such a motion, at least two weeks prior to the
`filing due date. See 37 C.F.R. § 42.121; 77 Fed. Reg. 48,756, 48,766 (Aug.
`14, 2012).
`Counsel for Petitioner represented that the related litigation, Ignite
`USA, LLC v. CamelBak Prods., LLC, No. 14-cv-09210 (N.D. Ill.), has been
`stayed.
`
`
`It is:
`ORDERED that no motions are authorized at this time.
