`DEFENDANTS’ JOINT PROPOSED CLAIM CONSTRUCTIONS PURSUANT TO
`OCTOBER 23 SCHEDULING ORDER
`
`
`PRELIMINARY STATEMENT
`
`Pursuant to the Court’s October 23, 2014 Scheduling Order (D.I. 24 in C.A. No. 15-610),
`
`Defendants AT&T Mobility LLC; Sprint Spectrum LP; Virgin Mobile USA LP; Nextel
`
`Operations, Inc.; T-Mobile US, Inc.; TracFone Wireless, Inc.; United States Cellular Corp.; and
`
`Cellco Partnership d/b/a Verizon Wireless (collectively, “Defendants”) propose the following
`
`preliminary claim constructions.
`
`Defendants base these constructions upon their current knowledge, understanding, and
`
`belief as to the facts and information available as of this date. As Defendants have not yet
`
`
`
`2
`
`
`
`
`completed their investigation, collection of information, or discovery relating to these actions,
`
`they expressly reserve the right to supplement, amend, and/or otherwise modify their preliminary
`
`claim constructions, including offering separate constructions for terms that are included within
`
`larger proposed terms identified in this document and including arguing that one or more
`
`proposed terms identified in this document do not require construction.
`
`As Defendants have previously contended, certain asserted claims are invalid for, among
`
`other grounds, failing to comply with 35 U.S.C. § 112. Any proposed constructions of terms,
`
`phrases, or clauses with respect to such claims does not imply that such claims satisfy 35 U.S.C.
`
`§ 112, and any indication that any term, phrase, or clause does not satisfy 35 U.S.C. § 112 does
`
`not imply that any other claims do satisfy 35 U.S.C. § 112.
