`pursuant to 37 C.F.R. §42.70(a). According to the Scheduling Order (Paper No.

`24) entered on February 16, 2016, oral argument is currently scheduled for

`September 14, 2016. Without waiving consideration of any issue not listed below,
`
`Levine specifies the following issues to be addressed:
`
`1. Whether claims 4, 5, 8, 9, 10, 14 and 16 of U.S. Patent No. RE39,618
`
`are patentable over the asserted art and the grounds of unpatentability
`
`on which IPR2015-01341 was instituted.
`
`2. Any motion to exclude evidence filed by Petitioner.
`
`3. Any other issues specified by The Boeing Company in its Request for
`
`Oral Argument.
`
`4. Any other issues that the Board deems necessary for issuing a final
`
`written decision.
