`The district court proceedings involving U.S. Patent No. 6,519,581 are currently on appeal to the United
`States Court of Appeals for the Federal Circuit. See Appeal Nos. 16‐1128, 16‐1129, 16‐
`1132. Intellectual Ventures filed its opening brief on January 27, 2016. Though Intellectual Ventures
`has settled with Highmark, a party not involved in the proceedings before the Office, the appeal
`involving Petitioners, Old Republic et al., remains pending. In its opening brief, Intellectual Ventures
`asserts that the United States District Court for the Western District of Pennsylvania incorrectly
`concluded that Intellectual Ventures does not own the 581 patent. Petitioners are not aware of efforts
`by Intellectual Ventures to perfect patent ownership. Petitioner’s responsive brief in the Federal Circuit
`appeal is currently due on April 8, 2016.

`Besides the instant four IPR petitions, the ’581 Patent is involved in the following district court
`proceedings: Intellectual Ventures I LLC et al. v. Old Republic General Insurance Group, Inc., et al, Civ. No.
`2:14‐cv‐ 01130 (W.D. Pa); Intellectual Ventures I LLC et al. v. Highmark, Inc., et al, Civ. No. 2:14‐cv‐01131
`(W.D. Pa); Intellectual Ventures I LLC et al. v. Erie Indemnity Company, et al, Civ. No. 1:14‐cv‐00220
`(W.D. Pa). These three district court cases were consolidated for pre‐trial purposes. See Dkt No. 46 in
`14‐cv‐01130 (Old Republic); Dkt. 50 in 14‐cv‐01131 (Highmark); Dkt. 50 in 14‐cv‐ 00220 (Erie).

`On September 25, 2015, the District Court for the Western District of Pennsylvania held that Intellectual
`Ventures I LLC (“IV”) lacked standing to sue for infringement of the ’581 patent because IV does not own
`the ’581 patent. Ex. 2010; Exs. 1031‐32. IV filed Notices of Appeal in all three cases. Exs. 2023‐24; Dkt.
`126 in 14‐cv‐ 00220 (Erie).

`On March 11, 2016, the Court of Appeals for the Federal Circuit issued an order remanding the case to
`the district court. Intellectual Ventures I LLC et al. v. Highmark, Inc. et al., No. 2016‐1129, Dkt. 9 at 2
`(Fed. Cir. Mar 11, 2016). According to the Court’s order, the parties have settled the appeal and wish to
`“move the district court to vacate its September 25, 2015 memorandum opinion.” Id. The parties did
`not “indicate that the settlement is conditioned upon vacatur.” Id. The Court took no position as to
`whether the district court should grant the motion to vacate or on the merits of IV’s appeal. Id. At this
`time, the district court’s order that IV does not own the ’581 patent stands undisturbed.

`Patent Owner Intellectual Ventures I LLC respectfully provides the following status update
`regarding U.S. Patent No. 6,519,581 (“the ’581 Patent”).
`
`
`
`Status of Litigation or Other Proceedings:
`
`
`The ’581 Patent was asserted in three district court patent infringement suits: Intellectual
`Ventures I LLC, et al. v. Erie Indemnity Co., et al., No. 1:14-cv-00020-MRH (W.D.
`Pa.); Intellectual Ventures I LLC, et al. v. Highmark, Inc., et al., No. 1:14-cv-01131-MRH (W.D.
`Pa.); and Intellectual Ventures I LLC, et al. v. Old Republic Gen. Ins. Gp., Inc., et al., No. 2:14-
`cv-01131-MRH (W.D. Pa.). In the Highmark and Old Republic cases, the district court entered a
`final order of dismissal regarding the ’581 Patent on grounds that Intellectual Ventures did
`not have standing to maintain the infringement suit in view of the district court’s determination
`that a previous assignment in the chain of title was not effective to transfer ownership of the
`application that led to the ’581 Patent. In the Erie Indemnity case, the district court entered
`a final judgment under Rule 54(b) on the same basis. In each of the cases, the district court also
`determined that the asserted claims of the ’581 Patent were patent ineligible under 35 U.S.C. §
`101.
`
`Intellectual Ventures appealed the district court’s decisions to the U.S. Court of Appeals for the
`Federal Circuit (Appeal Nos. 2016-1128, -1129, and -1132), and the Federal Circuit has
`consolidated the appeals. Intellectual Ventures has since resolved its disputes with Highmark.
`
`Intellectual Ventures filed its opening appeal brief in the Federal Circuit on January 27,
`2016. That brief addressed both the standing and patent eligibility issues involving the ’581
`patent (as well as issues involving other patents that are part of the appeals). Based on the
`
`
`
`briefing schedule, Intellectual Ventures anticipates that briefing will be complete by late April,
`2016 and that the Federal Circuit will schedule oral argument about three to five months later.
`
`
`Other than the Western District of Pennsylvania cases identified above, the corresponding
`Federal Circuit appeals, and the present four IPR proceedings, the ’581 patent is not involved in
`any other proceedings.
`
`
`Status Regarding Ownership of the ‘581 Patent:
`
`
`As explained in the briefing Intellectual Ventures previously submitted in these IPRs, Intellectual
`Ventures contends that the prior assignments in the chain of title (including the assignment from
`AllAdvantage.com to Alset Inc.) were effective to transfer ownership of the application that led
`to the ’581 patent to Intellectual Ventures’ predecessors-in-interest, and, therefore, Intellectual
`Ventures is the owner of the ’581 Patent.
`
`Intellectual Ventures has attempted to locate representatives of AllAdvantage.com in order to
`obtain a confirmation of the assignment, but it has been unsuccessful in locating any such
`representatives. Intellectual Ventures is also unaware of any further efforts by Petitioners
`to properly effect service of their Petitions on AllAdvantage.com, assuming that Petitioners are
`correct in their arguments that the AllAdvantage.com to Alset assignment was not effective to
`transfer title to the assignment leading to the ’581 Patent.
