`On October 24, 2017, Petitioner filed a Motion to Expunge the
`version of Exhibit 1023 that was filed on September 29, 2017. Paper 45. In
`its Motion, Petitioner represents that Patent Owner objected to pages 8–10,
`which Petitioner agreed to remove. Id. But then, “due to a clerical error, an
`earlier version of Exhibit 1023 containing pages 8-10 was filed on
`September 29, 2017[,] instead of the version that removed pages 8-10.” Id.
`Petitioner represents that it has “filed a corrected Exhibit 1023 that replaces
`pages 8-10 with blank pages in order to preserve the Bates numbering of
`Exhibit 1023” and “respectfully request that the version of Exhibit 1023 that
`was filed on September 29, 2017 be expunged from the record.” Id.
`Patent Owner had one month to file an opposition (37 C.F.R. § 42.25
`(a)(2)), but did not do so.

`
`Accordingly, it is:
`ORDERED that, pursuant to 37 C.F.R. § 42.7(a), the version of
`Exhibit 1023 that was filed on September 29, 2017, is expunged.
