`Case IPR2016-00059 (Patent 7,073,158 B2)
`Case IPR2016-00144 (Patent 7,587,699 B2)
`____________
`
`
`
`Before JUSTIN T. ARBES, THOMAS L. GIANNETTI, and
`ROBERT L. KINDER, Administrative Patent Judges.
`
`KINDER, Administrative Patent Judge.
`
`JUDGMENT
`Termination of the Proceedings
`37 C.F.R. § 42.72
`
`
`
`
`
`IPR2016-00059 (Patent 7,073,158 B2)
`IPR2016-00144 (Patent 7,587,699 B2)
`
`
`On April 26, 2016, the parties filed, in each of the instant proceedings,
`a joint motion to terminate the proceeding on the basis of a settlement
`reached by the parties. IPR2016-00059, Paper 7, IPR2016-00144, Paper 7.
`See 35 U.S.C. § 317(a); 37 C.F.R. § 42.72. The parties also filed a copy of
`their written settlement agreement and a request that the settlement
`agreement be treated as business confidential information under 35 U.S.C.
`§ 317(b) and 37 C.F.R. § 42.74(c). See IPR2016-00059, Paper 8, Ex. 1025,
`IPR2016-00144, Paper 8, Ex. 1016.
`We have not yet entered a decision on institution in either proceeding.
`The parties submit that termination is appropriate because the parties have
`settled their dispute and have reached agreement to terminate each of these
`IPRs. See, e.g., IPR2016-00059, Paper 7, 3. Based on the facts of these
`cases, it is appropriate to enter judgment terminating the proceedings
`without rendering a final written decision. See 35 U.S.C. § 317(a);
`37 C.F.R. § 42.72.
`
`ORDER
`
`Accordingly, it is
`ORDERED that the joint motions to terminate IPR2016-00059 and
`IPR2016-00144 are granted;
`FURTHER ORDERED that the above cases are hereby terminated as
`to all parties, including Petitioner and Patent Owner; and
`FURTHER ORDERED that the parties’ joint requests that the
`settlement agreement be treated as business confidential information, kept
`separate from the files, and made available only to Federal Government
`agencies on written request, or to any person on a showing of good cause,
`pursuant to 35 U.S.C. § 317(b) and 37 C.F.R. § 42.74(c), are granted.
