`INTER VIE W SUMMARY
`
`Applicants’ attorneys thank Examiner Stephen G. Sherman for his comments during
`
`an in person interview on July 26, 2010 with Robert Beyers and Cyndi Wheeler. In the
`
`interview, the Examiner agreed that amendments proposed by the Applicant’s representatives
`
`would overcome the current rejections. In particular, the Examiner agreed that amending
`

`REMARKS CONCERNING REJECTIONS UNDER 35 US. C. 103
`
`To establish prima facie obviousness of a claimed invention, all the claim elements
`
`must be taught or suggested by the prior art. In re Royka, 490 F.2d 981, 180 USPQ 580
`
`(CCPA 1974). Indeed, the Board of Patent Appeal and Interferences recently confirmed that
`
`a proper obviousness determination requires an Examiner to make "a searching comparison
`
`of the claimed invention - including all its limitations - with the teaching of the prior art." See
`
`In re Wada and Murphy, Appeal 2007-3733, citing In re Ochiai, 71 F.3d 1565, 1572 (Fed.
`
`Cir. 1995) (emphasis in original). Finding all the claim elements in the prior art is necessary,
`
`but not sufficient. KS'R Intern. Co. v. Teleflex Inc., 127 S.Ct. 1727, 1741 (2007) ("a patent
`
`composed of several elements is not proved obvious merely by demonstrating that each of its
`
`elements was, independently, known in the prior art"). "All words in a claim must be
`
`considered in judging the patentability of that claim against the prior art." In re Wilson, 424
`
`F.2d 1382, 1385, 165 USPQ 494, 496 (CCPA 1970).

`Examiner agreed that claim 2, as amended, overcomes the present rejection under 35 U.S.C.

`103. Thus, claim 2 and the claims that depend therefrom (namely claims 3-49) are patentable
`
`over Gillespie and Funakami.
`
`Additionally, independent claims 1 and 50-53, as amended, include analogous

`limitations to claim 2. Thus, claims 1 and 50-53 are also patentable over Gillespie and
`Funakami for similar reasons.

`amended claim 2. As discussed in Section C above, Gillespie and Funakami do not teach at

`least one limitation of amended claim 2. Lai also fails to teach this claim limitation. Because

`Gillespie, Funakami and Lai, whether taken separately or together fail to teach at least one
`
`claim limitation of claim 2, there is no prima facie case of obviousness for claim 2 and
`
`associated dependent claims 27-33. As such, Applicants respectfully request that these
`
`rejections be withdrawn.

`Rejection of claims 40-43 and 49 under 35 U.S.C. 103(a) as being unpatentable
`over Gillespie et al. in view of Funakami et al. and further in view of Hillis et al.
`(US 2006/0125799).

`Claims 40-43 and 49 depend from claim 2 and therefore include all of the limitations
