`We authorized the parties via e-mail dated October 3, 2016, to file a
`
`joint motion to terminate these proceedings and file their settlement
`
`agreement as business confidential information under 37 C.F.R. § 42.74(c).
`
`On October 7, 2016, the parties filed their joint motion to terminate. Paper
`
`9.2 The parties also filed a true copy of a written settlement agreement
`
`(Ex. 2003), along with a joint request to keep the agreement confidential.
`
`Paper 10.
`
`We have not instituted trial in these proceedings. Thus, these
`
`proceedings are in their initial stages. The parties indicate that they have
`
`agreed to resolve all disputes between them related to the challenged patent.
`
`Paper 9, at 1. Under these circumstances, we determine that it is appropriate
`
`to dismiss the petition. See 37 C.F.R. §§ 42.5(a), 42.71(a). This paper does
`
`not constitute a final written decision pursuant to 35 U.S.C. § 318(a).
`
`Accordingly, it is
`
`ORDERED that the Joint Motions to Terminate IPR2016-01170 and
`
`IPR2016-01173 are granted;
`
`FURTHER ORDERED that the Joint Requests to File Settlement
`
`Agreement as Confidential Business Information and to Maintain Said
`
`Agreement Separate from the Public File Pursuant to 35 U.S.C. § 317(b) and
`
`37 C.F.R. § 42.74(c), Paper 9, are granted; and
`
`FURTHER ORDERED that the Petitions for Inter Partes Review in
`
`IPR2016-01170 and IPR2016-01173 are dismissed.
`
