`On November 8, 2017, a conference call was held between counsel for the
`parties and Judges Smith, Braden, and Galligan. Patent Owner provided a court
`reporter and stated that it will file the transcript and any errata form in due course
`as an exhibit.
`Patent Owner initiated the conference call to request leave to file a motion to
`strike allegedly new evidence and new arguments raised in Petitioner’s Reply
`(Paper 25). Petitioner opposed, asserting that (1) Petitioner did not make new
`arguments or present new evidence, and (2) if Petitioner did make new arguments
`or present new evidence, Petitioner did so to rebut Patent Owner’s arguments made
`in Patent Owner’s Response (Paper 20).
`After consideration of the parties’ positions, the Board authorizes Patent
`Owner to file a motion to strike new evidence and new arguments raised in
`Petitioner’s Reply. The page limit for this motion is seven (7) pages, and the filing
`deadline is 5 pm ET Monday, November 20, 2017. The Board authorizes
`Petitioner to file an opposition to Patent Owner’s motion to strike. The page limit
`for the opposition is seven (7) pages and the filing deadline is 5 pm ET Friday,
`December 1, 2017. No other filings are authorized at this time.
`Accordingly, it is
`ORDERED that Patent Owner’s request to file a motion to strike is granted,
`limited to seven (7) pages, and must be filed no later than 5 pm ET on Monday,
`November 20, 2017;
`FURTHER ORDERED that Petitioner is authorized to file an opposition to
`Patent Owner’s motion to strike, limited to seven (7) pages, and must be filed no
`later than 5 pm ET on Friday, December 1, 2017; and
`FURTHER ORDERED that Patent Owner is to file a copy of the conference
`call transcript as an exhibit into the proceeding with any errata form.
