`Fred Hillebrand presented a proposal of the SMG Co-ordination Group (SMG CG) concerning
`information to the press:
`• ETSI should inform about the results
`• Christopher Corbett and Fred Hillebrand will elaborate a press release
`• The press release will be presented to SMG for approval
`• The press is invited for a briefing on Thursday 29 January 17:00 hours
`• The SMG CG recommended that no interim results should be communicated to
`the press.
`
`This proposal was approved by SMG#24bis.
`
`François Grassot proposed to in addition inform the press - without further comments - about the
`result of 28th January voting. This was approved by SMG#24bis.
`
`Later in the meeting, SMG#24bis approved the press releases of 28th and 29th January 1998 in
`Annex 3 and Annex 4.

`REVIEW OF THE IPR SITUATION
`
`Fred Hillebrand reminded the delegates of the obligations from the ETSI IPR policy, in particular
`resulting from section 4.1 of the ETSI IPR policy:
`
`“4.1 Each MEMBER shall use its reasonable endeavours to timely inform ETSI of
`ESSENTIAL IPRs it becomes aware of. In particular, a MEMBER submitting
`a technical proposal for a STANDARD shall, on a bona fide basis, draw the
`attention of ETSI to any of that MEMBER's IPR which might be
`ESSENTIAL if that proposal is adopted.
`
`4.2
`
`The obligations pursuant to Clause 4.1 above do however not imply any
`obligation on MEMBERS to conduct IPR searches.”

`ETSI Legal Advisor Hélène Lafferre informed the meeting that further declarations on WCDMA
`and TD-CDMA have been received, see Tdoc SMG 21/98, Report on Essential IPRs
`declared in relation to the work of SMG#24.
`
`Question Josef Huber: 60 companies were identified by Siemens to have UTRA
`relevant patents. How many of them gave the necessary declarations to ETSI?
`
`Answer Hélène Lafferre: Around 20 of the 60 have responded. The companies have 3
`months time to react. Some companies declared that their study is going on. 39
`declarations have been received in total.
`
`Adriana Nugter informed SMG#24 that GSM MoU sent out a letter to relevant parties asking for
`identification of relevant IPRs and of the companies’ IPR policy. Deadline for answers
`was 7th January 1998. The answers received until that date were too few to establish a
`basis of information. Due to this uncertainties, IPR questions are not considered in GSM
`MoU as a decisive point at this point in time.
`
`Tdoc SMG 23/98, Motorola IP Policy for UMTS, source Motorola, expresses Motorola’s believe
`the IPR environment strongly to favour TD-CDMA.
`
`Ruprecht Niepold presented a statement of the European Commission, see Tdoc SMG 22/98, Draft
`Declaration on UMTS on the occasion of the SMG #24bis (Paris 28-29 January 1998)
`by the representative of the services of the Commission (Counsellor to ETSI). Major
`points:
`• The Commission recognises the role of ETSI to define the 3rd generation standard
`for the European Economic Area.
`• ETSI must use clear transparent rules in that definition process.
`• A fair IPR policy is necessary.
`• Competition rules may become applicable when the holder of a UMTS Essential
`IPR or a group of UMTS IPR holders occupy a dominant position in respect of
`the IPRs necessary to comply with the UMTS standard: Should abuses occur, the
`Commission will consider which appropriate action to take in enforcement of
`Community law and in support of EU policy. In this context the Community
`competition rules regard a group of companies under common control as a single
`commercial entity.
`
`Heikki Ahava presented Tdoc SMG 7/98, IPR LICENSING POLICY STATEMENT FOR WCDMA,
`source Ericsson, Nokia, NTT DoCoMo, NEC, Fujitsu, Matsushita (Panasonic),
`Mitsubishi Electric, informing about activities of these companies on handling IPRs in
`an open process.
`
`Representatives of the delta concept group reported on similar activities of the
`protagonists of the delta concept.
`
`Adriana Nugter on behalf of GSM MoU welcomed the initiatives taken by some companies in the
`field of IPR.
`
`On behalf of Qualcomm, Ronald E. Foerster reported Qualcomm to have signed and to fully
`support the ANSI IPR policy, also Qualcomm to have IPR agreements with 50 to 60
`manufacturers; Qualcomm to have concluded to have a strong IPR position in both the
`alpha and the delta concept, but to need to investigate this and prepare an IPR position.

`Dirk Weiler commented Siemens investigations not to have identified any essential
`Qualcomm IPR relevant for the delta concept.
`
`Ronald E. Foerster reported furthermore Qualcomm to be interested to contribute to and
`to discuss a concept which might simplify the IPR handling; but time to be needed to
`study and analyse the matter.
`
`Rémi Thomas asked whether the Qualcomm IPR policy could be expected to be
`clarified until SMG#25.
`
`Ronald E. Foerster responded Qualcomm to be looking very hard to elaborate its
`position in order to come to a conclusion as soon as possible. He indicated that
`Qualcomm will present a progress report on IPR at SMG#25.
`
`Gunnar Sandegren and Alan Cox expressed the view that, in any case, Qualcomm has to
`apply the ETSI IPR policy.
`
`It was concluded that, on IPR questions, ETSI/SMG cannot go further than the ETSI IPR policy
`defines; further IPR arrangements have to be found outside of SMG, e.g., between the
`big commercial players.
`
`2.2
`
`STATUS OF CONCEPTS
`
`Werner Mohr (Siemens) explained that, since SMG#24, discussions for consensus with the alpha
`concept proponents have taken place, however with no conclusion so far. He announced
`further information to become available during SMG#24bis.
`
`Josef Huber indicated Tdoc SMG 19/98, TD-CDMA (delta), the true global solution for multimedia
`services, source Alcatel, Bosch, Italtel, Motorola, Nortel, Siemens and Sony, to contain
`relevant results on the UTRA definition.
`
`Mikael Gudmundson presented Tdoc SMG 6/9, Enhancements of the WCDMA concept by the
`introduction of key aspects from the TD/CDMA concept, source: Ericsson, Nokia, NTT
`DoCoMo, NEC, Fujitsu, Matsushita (Panasonic), Mitsubishi Electric.
`
`This paper outlines the introduction of a TDMA component to WCDMA/TDD in order
`to improve the capabilities for uncoordinated operation and the possibility to use
`optional joint-detection for WCDMA/TDD.
`
`Andy Wilton presented Tdoc SMG 14/98, Merging the Alpha and Delta Proposals on UTRA,
`source Motorola, analysing the proposal of an enhanced Alpha concept made by a group of
`manufacturers supporting WCDMA.
`
`Andrew Bell, NEC, argued the criteria of Tdoc SMG 14/98 not to be those agreed in the
`UTRA definition process.
`
`Peter Adams presented Tdoc SMG 2/98, In support of W-CDMA for UMTS, source BT. The paper
`supports the selection of the alpha group, reasoning it to have the highest potential to
`become a global standard; it proposes that, if SMG couldn’t decide on the UTRA
`concept, the GA should take the decision.
`

`Several speakers stated that according to the ETSI rules, a decision in this matter can
`only be transferred to GA on decision of SMG, also that SMG#24 had a voting
`participation as a GA, whence a different situation in the GA not to be likely.
`
`Bengt Nordström presented Tdoc SMG 16/98, GSM Network Operators in Asia Pacific Express
`Support for Wideband CDMA Based on GSM Platform, source: 16 Operators in Asia
`Pacific, supporting the alpha concept.
`
`
`
`Josef Huber interpreted the opinion of 16 out of 84 operators in Asia Pacific as a
`minority. Paul Simmons argued Asia Pacific operators to want a single solution, but to
`be neutral to the solution (alpha or delta) itself.
`
`Jean Pierre Charles presented Tdoc SMG 17/98, source France Télécom, SFR, T Mobil, Deutsche
`Telekom, Cegetel, E-Plus Mobilfunk. The document notes ongoing work for a common
`compromise on the UMTS standards and actions to solve the IPR issue. It requests a
`further period of eight weeks in order to give sufficient time to the proponents to reach
`an acceptable compromise for a common global standard and a clear IPR situation. The
`position was
`supported by Didier Chauveau on behalf of ART
`and
`Juan Antonio Moreno on behalf of Telefónica. This proposal did not find consensus.
`
`Scott Fox presented Tdoc SMG 20/98, Requirements for a single global UTRA standard, source
`BellSouth Mobility/GSM North America, arguing the alpha and delta concept to have
`the potential to meet the requirements and asking proponents to continue work on their
`concept in order to fulfil the requirements.
`
`Alistair Urie presented Tdoc SMG 18/98, Cordless Telephony Support (CTS) through UMTS
`Comparison of solutions based on TD-CDMA and on WB-CDMA, source Alcatel,
`seeing advantages of the delta group in cordless telephony systems applications.
`
`Kiyoyuki Tsujimura presented Tdoc SMG 12/98, NTT DOCOMO’S VIEWPOINTS ON THE
`NEXT-GENERATION MOBILE COMMUNICATIONS SYSTEM, source
`NTT DoCoMo, emphasizing the needs for mobile multi-media services in the
`3rd generation mobile systems and recommending the alpha concept as the
`best solution.
`
`Steven Goode presented Tdoc SMG 15/98, Cost, Power, and Size of TD-CDMA Terminals over
`WB-CDMA Terminals for Dual-Mode, High Mobility Cellular Environments, source
`Motorola, seeing advantages in cost, power and size for dual mode terminals with a delta
`component .against dual mode terminals with an alpha component.
`
`Further points like guard bands and minimum bandwidth necessary for operation were discussed in
`a controversial manner without conclusions.
`
`2.3
`
`RESULTS OF THE VOTING
`
`Bernd Eylert, Chairman of the UMTS Forum Operators Group, informed SMG#24bis that he had
`asked the Operators Group members - as initiated by some operators -whether they
`would agree to postpone the weighted individual voting in order to reach a consensus
`supported by all parties involved; twenty Operators replied, of whom 9 were in favour
`of a postponement as described above and 11 were in favour of a definite decision to be
`taken at SMG#24bis.

`their vote what technical solution among the proposed concepts alpha, beta,
`gamma and delta they want to chose for UTRA.”

`Background: It is the understanding of SMG that by deciding to base the UMTS Terrestrial Radio
`Access on a given concept, SMG approves the summary of the system description for
`that concept. This means that the further refinement of the selected concept is done with
`reference hereto. Meaning that changes in order to improve the concept shall be justified
`relative to the concept described in the summary system description.
`
`The documentation for the four concepts in question can be found in the following
`documents provided to SMG:
`• For the α-concept: Tdoc SMG 903/97
`• For the β-concept: Tdoc SMG 894/97

`Walter Konhäuser presented Tdoc SMG 29/98, Proposal for a Consensus Decision on UTRA,
`source Alcatel, Bosch, Ericsson, Italtel, Motorola, Nokia, Nortel, Siemens, SONY.
`
`Gunnar Sandegren informed that the consensus proposal had been further discussed with more
`companies. The revised document with these additional sources in Tdoc SMG 32/98,
`source Alcatel, Bosch, Cellnet, Deutsche Telekom, Ericsson, France Telecom, Fujitsu,
`Italtel, Mannesmann Mobilfunk, Matsushita (Panasonic), Mitsubishi Electric, Motorola,
`NEC, Nokia, Nortel, NTT DoCoMo, Siemens, SONY, Telia, TIM, T-Mobil, Vodafone.
`(The document is included as Annex 6 of this report with additional source companies.)

`It was agreed by SMG#24bis to proceed as follows:

`Tony Wiener clarified that GSM in the paper means the whole family, including DCS 1800 and
`PCS 1900.
`
`Hans Hauser commented a possible evolution to be that FDD only equipment would come to the
`market (terminals and base stations).
`
`Silvano Candeo indicated that Italian PT Ministry supports Tdoc SMG 29/98.
`
`Gunnar Sandegren clarified that changes relating to requirements should not be agreed at plenary if
`an already agreed document, under change control, exists. The usual change procedures
`should apply.
`
`David Barnes on behalf of DTI expressed support for the proposal, expressing some concerns on a
`possible fragmentation and proposing that the whole proposal should be forwarded for
`global application.
`
`Alistair Urie emphasized that by this proposed consensus now one system for UTRA has been
`identified.
`
`Werner Wiedermann stated on behalf of Post and Telekom Austria AG to abstain at a decision to
`the proposed agreement because of the unsolved third party IPR situation and possible
`additional costs due to the implementation of two different technologies for UMTS.
`
`Peter Adams stated on behalf of BT:
`
`“BT welcomes the prospect of an agreement in principle at SMG#24bis on
`UTRA and accepts the compromise proposed in Tdoc SMG 32/98 as the
`agreed way forward. BT notes that the global roaming requirements is
`safeguarded through the use on WCDMA in the FDD bands at least.”
`
`Raul Bruzzone stated on behalf of Philips Consumer Communications:
`
`“Philips Consumer Communications expressed concerns about some expected
`IPR positions not yet being submitted and about possible technical
`consequences of high level technical compromizes. These are further
`elaborated in Tdoc SMG 36/98.”
`
`Chris Cavigioli stated on behalf of Analog Devices:
`
`“Analog Devices enthusiastically welcomes this convergence for a world-
`wide solution and looks forward to assisting in the technical clarifications,
`especially
`in
`the area of dual-mode
`terminals, software radio and
`harmonization with the GSM family. We also look forward to the frequency
`band definitions in actual commercial practice throughout the world.”
`
`Herbert Jost stated on behalf of Swisscom:
`
`“Swisscom welcomes the principal spirit of the consensus as proposed in
`Tdoc SMG 29/98. However, the proposed schemes for FDD and TDD mode

`must be used only as a guideline for a refinement and optimization process
`performed by SMG2 with the goal of low cost and high performance
`terminals and infrastructure.”

`Wolfgang Ptacek stated on behalf of T-Mobil:
`
`“In section 3 under ‘consensus proposal’, FDD/TDD dual mode operation is
`listed as an objective.
`
`There may be countries with only paired spectra or with only very small TDD
`portions of the total spectrum granted to an operator. In such case, there may
`be sooner or later a temptation to employ FDD mode only UMTS mobiles and
`UMTS BSS equipment in order to save costs and to reduce complexity.
`Although international roaming clearly would suffer from making use of
`FDD mode only UMTS mobiles the issue of having one kind of UMTS
`mobile only and one kind of UMTS BSS equipment should be strongly
`considered when detailing the UTRA proposal.”
`
`2.5
`
`CONSENSUS BUILDING
`
`Niels Peter Skov Andersen presented the scope of the intended agreement: Tdoc SMG 29/98 -
`when and if approved -would set the basis for future development of UTRA performed
`by SMG2 together with the already approved SMG documents which are under Change
`Control: High level requirements, Procedure for the UTRA definition, UMTS 21.01,
`UMTS 30.03 (Evaluation Criteria).
`
`
`
`SMG#24bis agreed with this understanding.
`
`Tdoc SMG 39/98 was approved by SMG#24bis, it is Annex 5 of this report.
`
`Kiyoyuki Tsujimura on behalf of NTT DoCoMo stated that NTT DoCoMo supports this decision as
`the basis for development of IMT-2000.
`
`The further contents of Annex 6 of this report (revision of Tdoc SMG 32/98 and Tdoc SMG 38/98,
`the revision consisting in additional source companies of the paper) were noted.
`
`In particular, SMG#24bis acknowledged the commitment of the companies acting as
`source of the paper for taking the lead in providing the basis for a reasonable IPR
`situation for UTRA. SMG requested all members to contribute to that goal:
`
`This commitment reads
`
`“4. The above listed companies will work together to provide agreed
`guidelines for the handling of IPRs essential to the UTRA specification which
`result in reasonable cost for the manufacturers. This is proposed to limit the
`liability of the proposed standard to excessive IP demands which make access
`to the standard not commercially viable.”
`
`The companies signing as source of this paper will give a progress report on IPR
`questions to SMG#25.

`Akio Sasaki, Chairman of the ARIB Co-ordination Group, stated that on Monday, 2nd February,
`1998, a meeting of ARIB Co-ordination Group Meeting will take place. He will present
`Tdoc SMG 39/98 to that group for approval as a basis for future work on the IMT-2000
`radio access based on a close co-operation with SMG.
`
`Furthermore, SMG#24bis approved the following:
`
`“The way forward will in addition include the following items :
`• It is agreed that the UTRA should support operation in a spectrum allocation as
`small as 2 x 5 MHz.
`• UTRA should also be designed for broader spectrum allocation to satisfy the
`capacity requirements and service requirements outlined by the UMTS Forum,
`GSM MoU and SMG1
`
`Based on Tdoc 32/98 and on the items listed hereabove SMG2 will present a detailed
`technical proposal at SMG#25.”
`
`Thomas Beijer, Chairman of UMTS Forum, congratulated SMG, the SMG Chairman and all
`members, to this important achievement.
`
`Giuseppe Rao stated on behalf of the Italian Ministry of Communications:
`
`“The Italian Ministry of Communications expresses its satisfaction for the
`“consensus proposal”. Negotiations on relevant aspects are still necessary,
`however, the proposed solution goes in the right direction.
`
`The Ministry wants to congratulate ETSI and all the participants.”
`
`Ruprecht Niepold stated on behalf of the European Commission:
`
`“The Commission services welcome the achievement of a consensus on the
`basic concept for the UMTS radio interface and congratulates ETSI SMG and
`its members for this success.
`
`Commissioner Bangemann has personally and closely followed the work of
`SMG#24bis and is very satisfied with its results.
`
`
`The consensus achieved by SMG#24bis is fully in line with the position
`expressed by the Commission in its Communication to the European
`Parliament and Council COM(97)513 on UMTS.
`
`
`As a further element of support, the European Parliament in its plenary
`session of yesterday adopted a resolution supporting the development of
`UMTS and emphasising the need to proceed on the basis of a common, open
`and internationally competitive air interface.
`
`
`The debate on the basic concept for the radio access for UMTS has slightly
`delayed the standardisation agenda as originally foreseen, but we consider
`that this debate was necessary to achieve a consensus which offers the best
`conditions for the important work ahead to define the detailed UMTS
`standard specifications.”

`REPORT ON FUTURE ORGANISATION OF STANDARDISATION
`
`Fred Hillebrand presented Tdoc SMG 9/98, the progress report to SMG#24bis on future
`organisation of GSM and UMTS standardisation.
`
`It was clarified that the “XXX Forum” would be an ETSI partnership project and have similar
`partnership contracts with ARIB, T1P1, RITT etc. (question of Albert Dorgelo).
`
`It was clarified that the allocation of spectrum is not seen as a matter of the new group.
`
`On questions from Alan Hadden, it was clarified that GSM-UMTS is the term used by the ETSI
`GMM report: In the ETSI structure at present, the development of an GSM evolution
`UMTS Core network (GSM-UMTS Core network) is in the responsibility of SMG,
`whereas NA(6) is responsible for the ISDN evolution UMTS Core Network (ISDN-
`UMTS Core Network).
`

`Jean Gabriel Rémy, SFR and Peter Adams, BT commented that this new group could be seen as a
`rival to the ITU, given its global nature.

`Alan Cox reported that co-ordination with NA6 on the UMTS Core Network concepts is going on
`(after an uneasy start).
`
`It was clarified that the organisation would have an independent financial organisation, as described
`in the ETSI rules.
`
`The part of name “Forum” could suggest unintended conflicts in scope with the UMTS Forum
`(Chris Wildey).
`
`It was commented that Swiss law would not the only possibility for the Association.
`
`The progress report sees difficulties to give satisfying participation and influence to non-European
`companies by the proposed extension of voting rights for associate members (with its
`restrictions), in particular two problems with the new proposal for associate’s voting
`rights: Matters relevant for European Norms to be excepted from Associate members
`voting; full members’ only decision when 71% are not reached. It was requested that the
`final report at SMG#25 should give a complete analysis on this matter.

`David Barnes commented Fixed/Mobile Convergence as important to be guaranteed in the
`development.
`
`David Barnes commented that exact financial plans would be needed in time. Answer: Detailed
`papers have been forwarded to Per Björndahl’s task force on PT SMG funding for a
`detailed analysis.
`
`Alistair Urie commented that the STC chairs should not ex officio be members of the Advisory
`Group. He proposed to create the advisory group immediately.

`It was clarified that voting rights would be with the members of the new organisation, the links
`marked with a “P” in the structure diagram mean partnership contracts. (Question Rémi
`Thomas).

`Gerry Lawrence requested a future organisation to stay strictly in the limits set by the definition of
`an ETSI Partnership Project in the ETSI rules.
`
`Chris Cavigioli expressed concerns on more overhead for co-ordination in such a new organisation.
`He saw an alternative way by giving SMG more autonomy in ETSI. Alan Cox
`responded that such special rules also require a new organisation form, because ETSI
`rules could not just state rules and an exception case, namely SMG. Gunnar Sandegren
`commented that the overhead would be reduced by creation of the group, because global
`agreements are required and are easier to provide in a single specification body than by
`communication and common agreement in different bodies.
`
`Alan Cox commented that it should be made clearer that the new group would not be a standards
`organisation itself. The objective of the group should be the production of commonly
`available specifications. Standardisation Institutions like ETSI, ANSI, ARIB/TTC and
`RITT could take these specifications for inclusion into their standards.
`
`Paola Tonelli presented further objectives for the group:
`• Common specifications and global interoperability
`• conflict resolution
`• efficiency of standardisation, cost, speed
`• reduction of third generation development costs to manufacturers
`• regionally unbiased,
`• focused on operator/customer needs
`• membership to all.
`
`She argued that other groups like IETF, ISO, Frame Relay Forum, ATM Forum might
`be interested in co-operation agreements and announced that Airtouch is volunteering to
`assist establishing the contacts to IETF.

`FUTURE UTRA DEVELOPMENT

`Niels Peter Skov Andersen emphasized, that based on the broad avenue determined by SMG#24bis,
`all interested parties should sit together and continue work.
`
`In week 10, SMG2 will organise a workshop, as a joint workshop with the American, Japanese and
`Chinese colleagues, with open participation of any interested party on
`• the refinement and optimisation of the UTRA
`• the complete architecture of the UTRA BSS.
`
`Akio Sasaki on behalf of ARIB supported the proposal.
`
`It was clarified that participation would be open, in particular for organisations like TIA
`and ITU would be included.

`SMG2 Chairman, Niels Peter Skov Andersen.

`complete UMTS BSS part, and is much wider than the scope in ITU-R.
