`
`
`
`
`
`
`

`

`IPR2017-01357
`Patent 7,332,289 B2
`
`
`Petitioner Pfizer, Inc. respectfully moves for withdrawal of its back-up
`
`counsel, Ilan Wurman, as counsel for Petitioner in the above-captioned matter,
`
`pursuant to 37 C.F.R. § 41.5(c).
`
`STATEMENT OF MATERIAL FACTS AND RELIEF REQUESTED
`
`As provided for in 37 C.F.R. §11.116(a)(3), withdrawal is requested because
`
`Mr. Wurman is no longer at Winston & Strawn LLP.
`
`Pursuant to the provisions of 37 C.F.R. §11.116(b)(1), withdrawal can be
`
`accomplished without material adverse effect – Petitioner’s Lead Counsel, Mr.
`
`Jovial Wong, has not changed.
`
`Pursuant to 37 C.F.R. §11.116(c), Petitioner requested permission from the
`
`Board to file this motion for counsel to with draw on May 30, 2018, via email. The
`
`Board granted permission on May 31, 2018, via email.
`
`With respect to the requirements of 37 C.F.R. §11.116(d), Mr. Wurman has
`
`conferred with Petitioner, and Petitioner agrees that under the circumstances,
`
`withdrawal is appropriate and will not injure Petitioner’s interests.
`
`Patent Owner has previously indicated that it does not oppose this motion.
`
`Therefore, Petitioner respectfully requests that Mr. Wurman be withdrawn
`
`from further action in this matter.
