`was identified by the Examiner in the Office Action, which stated that the claims were re(cid:173)

`electronic display as captions for the hearing-impaired user during the

`receive the replacement block of text from the remote captioning service after the

`first block of text has been received and displayed by the second electronic

`display; and

`cause the replacement block of text to be displayed by the second electronic as an

`inline correction for the first block of text previously displayed by the
`
`second communication device.

`identifying receiving, through a first input device of the first communication device, corrections

`corresponding to an error within at least a portion of a text transcription post transmission

`after of the text transcription to a remote the second communication device configured to

`display the text transcription as a caption during a real time voice conversation between
`

`generating, at the first communication device, a replacement block of text responsive to the

`program stored in a first memory of the first communication device as executed by a first

`REMARKS
`
`The Office Action of October 22, 2015, has been received and reviewed. Claims 1
`
`through 21 are currently pending in the application. All pending claims stand rejected.
`
`Claims 1, 2, 4 through 13, 16, 17, and 19 through 21 have been amended, claims 3, 9, 14,
`
`15, and 18 have been canceled, and new claims 22 through 25 have been added herein. The
`
`amendments and new claims are supported at least by paragraphs [0025] through [0030] of the
`
`as-filed specification. No new matter has been added. All claim amendments and cancellations
`
`are made without prejudice or disclaimer. Reconsideration of the application is respectfully
`
`requested.
`
`Patent Examiner Interview Summary
`
`A phone interview was conducted on January 14, 2015 between Steven W. Gutke
`
`(attorney) and Examiner Gauthier. Applicant would like to thank the Examiner for the courtesy
`
`extended during the interview, which was very helpful in gaining an understanding of the
`
`Examiner's concerns.
`
`During the interview, proposed claim amendments were discussed, as were the
`
`Examiner's and Applicant's perspectives with respect to the rejections. It was agreed by the
`
`Examiner during the interview that the claim amendments would overcome the rejection of all
`
`claims under 35 U.S.C. 101. No conclusion was reached with regard to the Double Patenting
`
`rejection; however, claim amendments were discussed that the Examiner agreed to consider for
`
`overcoming the Double Patenting rejection. This subject matter has been incorporated into the
`
`claims for further consideration in an effort to remove outstanding issues and otherwise expedite
`
`prosecution. If the Office believes that further comments are necessary or desired describing the
`
`interview, the Examiner is kindly requested to contact Applicant's undersigned attorney, and
`
`further detail will be promptly provided.

`Double Patenting Rejection
`
`Claims 1 through 21 stand rejected under the judicially created doctrine of nonstatutory
`
`obviousness-type double patenting as assertedly being unpatentable over claims 1, 9, 14, 17, and
`
`29 of U.S. Patent No. 8,379,801 ("the '801 patent").
`
`As discussed above in the Patent Examiner Interview Summary, Applicant respectfully
`
`traverses this rejection. In an effort to advance prosecution, independent claims 1 and 13 have
`
`been amended in an effort to further narrow the claims and provide meaningful limitations such
`
`that a double patenting rejection is inappropriate in view of the claims in the '801 patent.
`
`Therefore, Applicant respectfully requests that the double patenting rejection of all claims be
`
`withdrawn.
`
`35 U.S.C. § 101 Rejection
`
`Claims 1 through 21 stand rejected under 35 U.S.C. § 101, asserting that the claimed
`
`invention is directed to non-statutory subject matter. As discussed above in the Patent Examiner
`
`Interview Summary, the Examiner agreed that the proposed claims recite statutory subject matter
`
`and overcome the rejection under 35 U.S.C. § 101. Therefore, Applicant respectfully requests
`
`that the rejection of all claims under 35 U.S.C. § 101 be withdrawn.
`
`New Claims
`
`New claims 22 and 23 depend from independent claim 1. New claims 24 and 25 depend
`
`from independent claim 13. At least by virtue of their dependent from an allowable claim,
`
`claims 28 through 33 should also be allowable.
