`Granting Joint Motion to Dismiss

`On August 21, 2017, Amazon.com, Inc. and Amazon Web Services,
`
`Inc. (“Petitioner,”) filed a Petition requesting inter partes review of claims 1,
`
`3, 4, 24, 25, 27, 32, 38–40, 43–45, 49–51, 54–58, 61–63, 66–68, 80, and 82
`
`of U.S. Patent No. 6,501,480 B1. Paper 1. On October 5, 2017, Petitioner
`
`and Broadcom Corporation (“Patent Owner”) filed a Joint Motion to
`
`Dismiss the Petition, accompanied by a true copy of a written agreement
`
`
`

`settling the parties’ disputes regarding the ’480 patent. Paper 7; Ex. 2001.
`
`The Motion represents that the parties “have executed a stipulation that
`
`resolves all of their disputes concerning the ’480 Patent.” Paper 7, 3. The
`
`parties further represent that there are no other collateral agreements or
`
`understandings made in connection with, or in contemplation of, the
`
`termination of the proceeding; and the stipulation dismisses with prejudice
`
`Patent Owner’s claims in regard to the ’480 Patent in the related district
`
`court lawsuit. Id. at 3–4.
`
`This proceeding is in a preliminary stage, and we have not yet issued a
`
`Decision whether to institute an inter partes review. Under these
`
`circumstances, Petitioner has demonstrated that dismissal of its Petition is
`
`warranted, and we grant the parties’ Joint Motion. See 37 C.F.R. § 42.71(a)
`
`(authorizing the Board to dismiss a petition).
`
`For the foregoing reasons, it is:
`
`ORDER
`
`ORDERED that the parties’ Joint Motion to Dismiss is granted and
`
`the Petition is dismissed.
