`
`Plaintiff SPEX Technologies, Inc. ("SPEX") provides this Disclosure of
`
`Asserted Claims and Infringement Contentions to Defendants Toshiba America
`
`Electronic Components Inc., Toshiba America Information Systems, Inc., and
`
`Toshiba Corporation
`
`(together, "Toshiba Defendants"), Western Digital
`
`Corporation, Western Digital Technologies, Inc., and HGST, Inc. (together
`
`“Western Digital Defendants”), Imation Corporation (“Imation”), Kingston
`
`Technology Corporation, Kingston Digital Inc., and Kingston Technology
`
`Company, Inc., (together, “Kingston Defendants”), Apricorn (“Apricorn”), Integral
`
`Memory, Inc. (“Integral Memory”), Datalocker, Inc. and Data Locker International,
`
`LLC (together "Datalocker Defendants") (collectively, “Defendants”). This
`
`disclosure is made solely for the purposes of this action.
`
`Discovery in this matter is at a very early stage and is ongoing. Defendants
`
`have not yet produced any documents and there have been no deposition testimony
`
`or other discovery responses in this action. SPEX's investigation regarding these and
`
`other potential grounds of infringement is ongoing. This disclosure is therefore based
`
`upon information that SPEX has been able to obtain publicly, together with SPEX's
`
`current good faith beliefs and information regarding the Accused Instrumentalities,
`
`and is given without prejudice to SPEX's right to obtain leave to supplement or
`
`amend its disclosure as additional facts are ascertained, analyses are made, research
`
`is completed, and claims are construed.
`
`These disclosures are based at least in part upon SPEX's present understanding
`
`of the meaning and scope of the claims of U.S. Patent No. 6,088,802 ("the "'802
`
`patent") and U.S. Patent No. 6,003,135 (the "'135 patent") (collectively, the "Patents-
`
`in-Suit") in the absence of claim construction proceedings in this action. SPEX
`
`reserves the right to seek leave to supplement or amend these disclosures if its
`
`understanding of the claims changes, including when the Court construes them in
`
`this action.

`

`
`
`
`In addition, upon information and belief, Defendants may use or offer
`
`presently unknown methods and systems that infringe the Patents-in-Suit.
`
`N.D. Cal. Patent L.R. 3-1(c)
`
`Charts identifying specifically where each limitation of each asserted claim is
`
`found within each Accused Instrumentality are attached to this disclosure. To the
`
`extent a chart is not directed to a specific product, SPEX's infringement theories are
`
`disclosed by the charts directed toward the same product class (e.g., USB jump
`
`drives, USB hard drives, SATA hard drives, SAS hard drives, etc.).
`
`N.D. Cal. Patent L.R. 3-1(d)
`
`The attached charts contain an identification of direct infringement and a
`
`description of the acts of the alleged indirect infringers that contribute to or are
`
`inducing that direct infringement.
`
`N.D. Cal. Patent L.R. 3-1(e)
`
`Each limitation of each asserted claim in the attached charts is alleged to be
`
`present literally. Where SPEX anticipates Defendants' argument against literal
`
`infringement, SPEX has also included disclosures pursuant to the doctrine of
`
`equivalents. To the extent one or more Defendant argues that other limitations are
`
`not present literally, SPEX asserts that the limitation is present under the doctrine of
`
`equivalents.
`
`N.D. Cal. Patent L.R. 3-1(f)
`
`Each asserted claim of the Patents-in-Suit is entitled to a priority date at least
`
`as early as June 4, 1997.
`
`N.D. Cal. Patent L.R. 3-1(g)
`
`SPEX does not assert that any of its own apparatuses, products, devices, or
`
`other instrumentalities practice the claimed invention.
