`Pursuant to 37 C.F.R. § 42.10, in response to the authorization provided by
`
`the United States Patent and Trademark Office’s Patent Trial and Appeal Board
`
`(“Board”) in the “Notice of Filing Date Accorded to Petition” (Paper Number 4,
`
`dated November 13, 2017, referred to herein after as “Notice”) to file this motion
`
`for pro hac vice admission and in accordance with “Order – Authorizing Motion
`
`for Pro Hac Vice Admission” in Case IPR2013-00639, Paper 7, Petitioner InAuth,
`
`Inc. submits this motion for Matthew D. Robson to appear pro hac vice. Petitioner
`
`respectfully requests that the Board recognize Mr. Robson pro hac vice during this
`
`proceeding.
`
`I.
`
`TIME FOR FILING
`
`Pursuant to the “Order – Authorizing Motion for Pro Hac Vice Admission”
`
`in Case IPR2013-00639, this motion for pro hac vice admission is being filed no
`
`sooner than twenty-one (21) days after service of the petition.
`
`II.
`
`STATEMENT OF FACTS
`
`Pursuant to the Order, the following statements of fact show that there is
`
`good cause for the Board to recognize Mr. Robson pro hac vice.
`
`Lead counsel for this proceeding, Peter J. Armenio, is a registered
`
`practitioner (Reg. No. 41,588).
`
`Mr. Robson is an experienced litigation attorney, having litigated over 20
`
`patent matters in federal district courts across the country and before the
`
`
`
`
`
`
`

`

`
`
`International Trade Commission, and a partner at the law firm of Quinn Emanuel
`
`Urquhart & Sullivan LLP. He has extensive experience in patent infringement
`
`matters including jury and bench trials, Markman hearings, and summary judgment
`
`hearings.
`
`Mr. Robson is counsel for the Petitioner in a co-pending litigation,
`
`mSIGNIA, Inc. v. InAuth, Inc.., Case No. 8:17-cv-1289, filed in the United States
`
`District Court for the Central District of California. This litigation involves U.S.
`
`Patent No. 9,559,852, the same patent that is at issue in this proceeding. During
`
`the co-pending litigation, Mr. Robson has reviewed the asserted patent, the
`
`relevant prosecution histories, the prior art references relied upon in the IPR
`
`Petition, and claim charts. As such, Mr. Robson has established familiarity with
`
`the subject matter at issue in this proceeding.
`
`Mr. Robson has read and will comply with the Office Patent Trial Practice
`
`Guide and the Board’s Rules of Practice for Trials set forth in part 42 of 37 C.F.R.,
`
`and he agrees to be subject to the USPTO Rules of Professional Conduct set forth
`
`in 37 C.F.R. §§ 11.101 et. seq. and disciplinary jurisdiction under 37 C.F.R. §
`
`11.19(a).
`
`Petitioner has expended financial resources in the co-pending litigation with
`
`Mr. Robson as counsel, and Petitioner wishes to continue using Mr. Robson in this
`
`proceeding.

`Accordingly, Petitioner respectfully submits that there is good cause for the
`
`Board to recognize Mr. Robson as counsel pro hac vice during this proceeding.

`This Motion for pro hac vice admission is accompanied by the Declaration
