`Granting Patent Owner’s Motions to Withdraw and Substitute Counsel

`1 We exercise our discretion to issue one order to be filed in each
`proceeding. The parties may use this style heading only if the paper includes
`a statement certifying that the identical paper is being filed in each
`proceeding listed in the caption.

`Pursuant to 37 C.F.R. § 42.10(e), Patent Owner filed Motions to
`Withdraw and Substitute Counsel in the above-referenced proceedings
`(collectively, “Motions”), seeking the withdrawal of Jeffrey G. Toler as lead
`counsel due to his inability to attend the upcoming oral argument and the
`withdrawal of Craig S. Jepson as back-up counsel due to his departure from
`Toler Law Group, PC. Paper 30, 1.2 Patent Owner also requests the
`substitution of current back-up counsel, Aakash Parekh (who is a registered
`practitioner), as new lead counsel. Paper 30, 1–2. Patent Owner further
`indicates that the other current back-up counsel, Benjamin R. Johnson, will
`remain as back-up counsel. Paper 30, 2. The Motion states that Petitioner
`does not oppose the Motion. Paper 30, 3.
`We have reviewed the Motions and determine that the requirements of
`37 C.F.R. § 42.10 have been met.3 The Motions are granted. Patent Owner
`should file updated mandatory notices removing Mr. Toler as lead counsel,
`removing Mr. Jepson as back-up counsel, and substituting Mr. Parekh as
`lead counsel.

`Similar Motions were filed in IPR2018-00205, IPR2018-00206, IPR2018-
`00207, and IPR2018-00208.
`3 Patent Owner further indicates it will also add Grantland Drutchas and
`George Lyons III as additional back-up counsel at a later date. Paper 30, 2.
`Patent Owner is reminded that they are required to submit the appropriate
`papers before Mr. Drutchas and Mr. Lyons are authorized to act as back-up
`counsel.

`ORDERED that Patent Owner’s Motions are granted and Mr. Toler
`and Mr. Jepson are allowed to withdraw as counsel for the above-identified
`proceedings;
`FURTHER ORDERED that Mr. Parekh is authorized to act as lead
`counsel for Patent Owner in the above-identified proceedings; and
`FURTHER ORDERED that Patent Owner shall file updated
`mandatory notices removing Mr. Toler as lead counsel, removing
`Mr. Jepson as back-up counsel, and substituting Mr. Parekh as lead counsel
`in accordance with 37 C.F.R. § 42.8(b)(3).
