`On May 7, 2018, Judges Jefferson, Evans, and Weinschenk held a
`telephone conference call with counsel for Petitioner, as well as Mr. Peter J.
`Corcoran, III. Mr. Corcoran represents Patent Owner in a related district
`court case, but, at the time of the call, he had not yet filed a power of
`attorney in this proceeding. During the call, Mr. Corcoran stated that he
`attempted to file a power of attorney and mandatory notices in the Patent
`Trial and Appeal Board’s End to End system (“PTAB E2E”) in February
`2018, and that he did not realize that those documents had not been filed.
`Mr. Corcoran noted that he served the power of attorney and mandatory
`notices on Petitioner in February 2018, which Petitioner confirmed. We
`requested that Mr. Corcoran attempt to file the power of attorney and
`mandatory notices again as soon as possible, and he agreed to do so.1 We
`explained to Mr. Corcoran that if he experienced any difficulty with the
`filing process, he could send an email to Trials@uspto.gov or call 571–272–
`7822 for assistance. Mr. Corcoran also stated that Patent Owner did not
`intend to file a Preliminary Response to the Petition. As a result, we
`explained that we will determine whether to institute an inter partes review
`in this proceeding under 35 U.S.C. § 314(a) based on the information
`presented in the Petition.
