`
`Shenzhen Silver Star Intelligent Technology Co., Ltd.
`Petitioner,
`
`v.
`

`Patent Owner
`
`
`
`
`
`
`Case: IPR2018-00897
`U.S. PATENT NO. 6,809,490
`
`PETITIONER’S REQUEST FOR REFUND
`OF POST-INSTITUTION FEES
`
`
`

`

`Petitioner, Shenzhen Silver Star Intelligent Technology Co., Ltd
`
`(“Petitioner”), hereby requests a refund of its post-institution fees in the amount of
`
`$15,000 deposited in the above matter on April 16, 2018, for the foregoing
`
`reasons:
`
`1.
`
`Petitioner filed its Petition for Inter Parties Review of claims 1-5, 7-8,
`
`12 and 42 of U.S. Patent No. 6,809,490 on April 16, 2018, in the above matter. At
`
`that time, Petitioner deposited with the Board the Inter Parties review request and
`
`post-institution fees in the total amount of $30,500. The fees included (1) $15,500
`
`for the Inter Parties review request fee; and (2) $15,000 for the Inter Parties review
`
`post-institution fee. The fees were charged to Arch & Lake LLP’s debit card.
`
`2.
`
`The institution of the IPR Case No. IPR2018-00897 was denied on
`
`October 1, 2018 and the notice of appeal was filed on October 22, 2018. On April
`
`11, 2019, Petitioner filed motion with United States Court of Appeals for the
`
`Federal Circuit to voluntarily dismissed the appeal on April 11, 2019, and the
`
`motion was granted on April 16, 2019.
`
`Because the IPR was dismissed prior to institution, Petitioner requests
`
`reimbursement of the post-institution fees of $15,000. Petitioner respectfully
`
`requests that the Board credit a refund in the amount of $15,000 to Arch & Lake
`
`LLP’s debit card or Deposit Account No. 60-2239.
`
`
