`I, Peter Jarred Land, declare and state as follows:

`I am President of RED.COM (“RED”), the assignee of U.S. Patent
`
`Nos. 9,230,299 (“the ’299 patent”) and 9,245,314 (the ’314 patent). I am
`
`submitting this declaration in connection with Patent Owner Preliminary
`
`Responses to IPR2019-01064 and IPR2019-01065, filed by Petitioner Apple Inc.,
`
`relating to the ’299 and ’314 patents, respectively.

`I joined RED in 2005, and was involved in the development of the
`
`RED ONE camera from its earliest stages. My title on the RED ONE project was
`
`Fire Chief, which characterized my responsibility for addressing any immediate
`
`issues that arose day-to-day to keep the RED ONE project moving forward.
`

`I had personal involvement with the testing of the RED ONE camera,
`
`nicknamed Boris, that took place at RED headquarters in March 2007.
`
`Specifically, members of the RED team, including myself, tested the visual output
`
`of Boris in preparation for the 2007 National Association of Broadcasters show
`
`(“NAB 2007”) to be held in Las Vegas in April. Members of the RED Team who
`
`were also present for that event included Jim Jannard, Graeme Nattress, Ted
`
`Schilowitz, David Macintosh and Stuart English. I recall Graeme Nattress taking
`
`pictures during that testing. I have reviewed Exhibits 2002-2008 that I understand
`
`are attached to Mr. Nattress’s declaration that is also being submitted with these
`
`Patent Owner Preliminary Responses to IPR2019-01064 and IPR2019-01065. I

`can confirm that Exhibits 2002-2008 depict RED’s testing of the Boris RED ONE
`
`camera at RED’s headquarters in March 2007.

`In Exhibit 2005, reproduced below, I am adjusting Boris’s focus as it sits atop a
`
`tripod.

`5. With regard to the photos reflected in Exhibits 2006, 2007 and 2008,
`
`reproduced below, respectively, I recall Messrs. Schilowitz and Macintosh sitting
`
`for the test shots reflected in those photos. I also recall viewing the output of that
`
`test video and confirming upon visual inspection that the raw compressed video
`
`shot by Boris displayed as visually lossless when decompressed and demosaiced. I
`
`also recall that the program used to display Boris’s test video reported that Boris’s
`
`video achieved 4K resolution at 24 frames per second, which can be seen in the
`
`annotation and enlargement of Exhibit 2008 below.

`After the successful testing of Boris at RED headquarters in early
`
`March, I flew with Mr. Jannard to New Zealand the week of March 26, 2007 to
`
`deliver Boris, and its companion camera nicknamed Natasha, to Sir Peter Jackson
`
`so that he could use them to shoot a movie entitled “Crossing the Line.” Like
`
`Boris, Natasha operated on REDCODE and utilized the same electronic
`
`architecture as Boris. Mr. Jannard and I spent that week in New Zealand
`
`overseeing Mr. Jackson’s use of the cameras. Exhibits 2013 and 2014, which I
`
`understand are attached to Mr. Jannard’s declaration that is also being submitted
`
`with these Patent Owner Preliminary Responses, are photos of Boris and Natasha
`
`in use on the set of “Crossing the Line.” In particular, Exhibit 2013, reproduced
`
`below, is a photo of Boris, having been powder coated black following the testing
`
`at RED headquarters earlier in March.

`(distinguishable from Boris by its milled aluminum exterior) in use during the

`At the March 2007 testing of Boris, and on the “Crossing the Line”
`
`shoot, Boris and Natasha utilized G-Tech memory drives. The G-Tech memory
`
`drives came in either 320 and 500 gigabyte sizes, both of which were compatible
`
`with Boris and Natasha. The G-Tech drives were tethered to the cameras via a
`
`SATA cable, which allowed us the flexibility to mount the drives in multiple
`
`locations, including to the top of the cameras.

`The “Crossing the Line” film shoot was a tremendous success and
`
`major milestone for RED, as Boris and Natasha succeeded in every way and
`
`circumstance that week with respect to their durability, portability and visually
`
`lossless video quality. Mr. Jackson prepared a cut of “Crossing the Line,” which
`
`we showed at NAB 2007 and received a tremendous, enthusiastic response.
`
`10. Part of my responsibility on the RED ONE project was to make sure
`
`that our contract engineering firm, Wind River, followed our instructions and
`
`timely met our required goals. Wind River acted at the direction of RED personnel
`
`throughout the RED ONE project.
`
`11. My responsibilities on the RED ONE project also required me to be
`
`generally familiar with the overall design of the camera, including its component
`
`parts and the high-level operation of REDCODE. The RED ONE had a Mysterium
`
`CMOS image sensor with a Bayer-pattern filter. REDCODE was programmed to
`
`take raw image data from the Bayer-pattern sensor and send it to a Xilinx
`
`processing module for pixel correction and further processing before being sent to
`
`an Analog Devices compression module, which utilized a JPEG 2000 compression
`
`technique. The compressed raw Bayer-pattern image data was then sent to a hard
`
`drive memory device through a SATA port.
`
`12. After NAB 2007, RED released several different RED ONE cameras
`
`having a variety of additional features, such as on-board video playback and on-
`

`board memory storage. I had responsibility for implementing the on-board
`
`memory storage feature that would allow a storage drive, such as a compact flash
`
`device, to be inserted within the side of the camera housing. For example, by at
`
`least January 29, 2007, I had confirmed the successful operability of a compact
`
`flash hard drive connected to the camera. That day I modified a G-Tech hard drive
`
`to accommodate a compact flash card and successfully recorded to it through the
`
`on-board port. Exhibit 2018, reproduced below, is a true and correct copy of a
`
`photo I took showing data successfully recording to the compact flash card, as
`
`shown by the illuminated “record” LED. Exhibit 2019 is a true and correct copy
`
`of metadata for Exhibit 2018 indicating a “Date taken” of “January 29, 2007.”

`13. At NAB 2007, which I attended, RED demonstrated a RED ONE
`
`camera that had a mock compact flash slot along the side of the camera housing.
`
`Exhibit 2020, reproduced below with annotations, is a true and correct copy of a
`
`photo taken at the RED booth at NAB 2007, showing a RED ONE display camera
`
`with an on-board compact flash slot to indicate that feature’s upcoming
`
`availability. Exhibit 2021 is a true and correct copy of metadata for Exhibit 2020
`
`indicating a “Date taken” date of “April 16, 2007.”
