`
`collectively “the Parties”), by and through their attorneys, hereby submit this Joint Claim
`
`Construction Chart identifying the terms and phrases of the claims in U.S. Patent Nos. 8,474,197
`
`(“the ’197 Patent”); 9,010,044 (“the ’044 Patent”); 9,382,713 (“the ’713 Patent”); 9,546,479

`(“the ’140 Patent”) and 10,072,415 (“the ’415 Patent”) (collectively, “the Patents in Suit”) that
`
`require construction.
`
`The Parties agree to the following constructions:

`
`Further, the Parties submit herewith Exhibit A, which provides proposed constructions of
`
`disputed claim language, as well as citations to the intrinsic evidence in support of each Party’s
`
`proposed constructions. The Parties’ citations to intrinsic evidence in U.S. Patent No. 8,474,197
`
`(“the ’197 Patent”) in Exhibit A incorporate by reference the analogous portions of the other

`that claim terms are to be construed consistently across all patents in the patent family.
`
`In addition to the intrinsic evidence specifically identified herein, the Parties reserve the
`
`right to rely on additional intrinsic evidence to the extent it is necessary to provide additional
`
`context or to rebut argument made during claim construction briefing. The Parties also reserve
`
`the right to rely on any intrinsic evidence identified by the opposing party. The Parties further
`
`reserve the right to rely on extrinsic evidence, including expert testimony, to the extent
`
`appropriate.
`
`Copies of the Patents in Suit and the intrinsic record relied upon by the Parties are
`
`attached herewith as Exhibits B-M.

`“Barrier layer”
`
`HEW maintains that
`this claim term alone
`does not require
`construction. Instead,
`the phrase “A barrier

`outer surface or the
`inner surface of each
`panel” (and its variants)
`should be construed, as
`discussed below in
`entry no. 7.
