`I am reaching out pursuant to 37 CFR § 42.54 to confer about a Motion to Seal and a proposed Protective Order. There are

`several documents (attached) that we intend to include as exhibits to our preliminary responses to Lutron’s PGR Petitions.
`
`The attached documents were produced in the underlying ligation and Lutron designated them ’CONFIDENTIAL—ATTORNEYS
`
`EYES ONLY” pursuant to the Protective Order.
`
`Our hope is that we can come to an agreement to either de—designate the documents we intend to use or to agree on a
`
`proposed protective orderto submit to the Board along with a Motion to Seal as required underthe rules. There is a default
`
`Protective Order, but assuming Lutron does not agree to de—designate, we propose that we request the Board enter the same
`
`Protective Order that the District Court entered and to which the parties have already agreed. But we are open to hearing
`yourthoughts.
`
`As the April 7 deadline for submission of Patentee’s preliminary response is a little less than two weeks away, we hope to be
`
`able to get this issue resolved quickly so that we have sufficient time to finalize our preliminary responses while ensuring
`
`Lutron’s materials are properly protected.
`
