`
`PATENT L.R. 4-3(c): IDENTIFICATION OF MOST SIGNIFICANT TERMS
`Bot M8’s Statement: Bot M8 does not consider any of the terms to be case dispositive.
`Sony’s Statement: The parties have identified six terms or groups of terms that are subject to
`substantive disputes. Sony believes that case-dispositive defenses are available without regard to the
`parties’ claim construction disputes. The following terms raise further dispositive issues for the
`patents in which they appear: “specification value” (’363 patent), “gaming machine” (’363 patent) and
`“execution order calculation section . . . / gaming program for causing the computer to execute the
`steps of . . .” (’777 patent).
`IV.
`PATENT L.R. 4-3(d): TIME FOR CLAIM CONSTRUCTION HEARING.
`The parties proposes two-hours for any claim construction hearing that the Court may hold for
`the terms addressed above.
`V.
`PATENT L.R. 4-3(e): WITNESSES AT CLAIM CONSTRUCTION HEARING.
`The parties do not expect to present live witness testimony at any claim construction hearing
`that the Court may hold, unless requested by the court.
`VI.
`PATENT L.R. 4-3(f): FACTUAL FINDINGS.
`The parties expect that factual findings will not be needed.
`Sony further states that, to the extent that factual issues arise in connection with the parties’
`claim construction positions (including disputes regarding indefiniteness of the “specification value”
`term or means-in-plus function construction of the “execution order calculation section” term), it
`requests that factual findings be made regarding such issues.
