`
`PETITIONER’S REQUEST FOR ORAL ARGUMENT
`
`
`
`

`

`Case No. IPR2020-00967
`Patent No. RE47,244
`
`
`Pursuant to the Board’s Scheduling Order dated December 1, 2020 (Paper
`
`14), Petitioner respectfully requests oral argument for the trial scheduled for
`
`September 8, 2021. Petitioner requests that the hearing take place remotely.
`
`Alternatively, if held in person, Petitioner consents to a hearing in Alexandria, VA,
`
`as per the Board’s Scheduling Order.
`
`Petitioner requests one (1) hour of argument time to address the below issues
`
`(or, if Patent Owner requests and is permitted more than 1 hour of oral argument
`
`time, Petitioner requests the same amount of time for oral argument as Patent
`
`Owner).
`
`On January 6, 2021, the PTAB indicated it “anticipates that a consolidated
`
`oral argument will be held for these three proceedings.” As such, Petitioner
`
`requests that Case Nos. IPR2020-00967; IPR2020-01019; and IPR2020-01033 be
`
`consolidated into a single oral hearing.
`
`Pursuant to 37 C.F.R. § 42.70(a), and as stated above, Petitioner requests
`
`one hour of time for each side and specifies the following issues, without intent to
`
`waive consideration of any issue not requested, to be argued for this proceeding:
`
`I. Whether Claims 1-26 of the RE244 Patent are obvious under 35
`
`U.S.C. § 103(a) based on the grounds presented in the Petition;
`
`II. Any issues specified by Patent Owner in its request for oral argument;
`
`and
`
`
`
`1
`
`

`

`Patent No. RE47,244
`
`
`III. Those issues of interest to the Board as raised in the parties’ papers
`
`and/or the Board’s institution decision.
