`In an Order dated September 10, 2011 (IPR2020-01016, Paper 7), the Board sua sponte
`authorized Petitioner MED-EL Elektromedizinische Geräte Ges.m.b.H. to file a 4-page
`Reply to Patent Owner’s Preliminary Response, to address the application of the Director’s
`August 18, 2020 AAPA Guidance Memo to Grounds 1 and 3.
`
`Petitioner respectfully requests authorization under 37 CFR § 42.108(c) for an additional
`four pages in the same Reply, including supporting exhibits, to address the Apple v. Fintiv
`factors raised by Patent Owner in its Preliminary Response (pp. 7-14), particularly in light of
`Patent Owner’s current infringement contentions and the district court’s current scheduling
`order (July 28, 2020, Ex. 2002) and recent Markman decision (September 9, 2020), both
`issued after the petition was filed on May 29, 2020.
