`Pursuant to 37 C.F.R. § 42.8(a)(2), Petitioners submit the following updated
`
`mandatory notices in connection with the above-captioned Petition for Inter Partes
`
`Review proceeding.
`
`I. Mandatory Notices
`A. Real Parties-in-Interest (amended)
`The real party-in-interest in this proceeding is VMware, Inc., who is the sole
`
`party who has funded this Petition and who has full and exclusive control over these
`
`proceedings. Out of an abundance of caution, VMware discloses that VMware, Inc.
`
`is a majority-owned subsidiary of EMC Corporation which is a wholly-owned
`
`subsidiary of Dell Technologies, Inc. VMware does not believe that either EMC
`
`Corporation or Dell Technologies, Inc. are real parties-in-interest and, as far as
`
`VMware is aware, neither EMC Corporation nor Dell Technologies, Inc. have ever
`
`been served with a complaint accusing them of infringing the ’818 patent.
`
`B. Related Proceedings (no change)
`There are at least two related proceedings. IV has asserted the ’818 patent
`
`against VMware in the Western District of Texas, Case No. 1:19-CV-01075. Further
`
`as noted above, VMware is challenging the ’818 patent in two petitions due to the
`
`length and differences of the claims challenged. See Ex. 1037 (Petition for IPR,
`
`Case No. IPR2020-00859); Petitioner’s Ranking and Explanation for Two Petitions
`
`Challenging U.S. Patent No. RE44,818 (concurrently filed). There appear to be no
`
`
`

`pending applications that claim priority to the ’818 patent or the ’789 patent from
`
`which it reissued.
`
`This identification of related matters is based on information that is currently
`
`known to Petitioner based on a reasonably diligent search of publicly available
`
`materials. IV may be aware of other proceedings—including proceedings before the
`
`Board or otherwise before the Office—relating to patent claims encompassing
`
`similar subject matter or raising similar issues to those involved here.
