`Pretrial Proceedings in a Patent Case (ECF No. 41), and Local Rules 4.1(c) and (d),

`U.S. Patent No. RE47,353 (“the RE353 patent”), U.S. Patent No. RE47,249 (“the
`RE249 patent”), U.S. Patent No. RE47,218 (“the RE218 patent”), and U.S. Patent
`No. 10,255,994 (“the ’994 patent”). In addition, Defendants hereby provide a
`preliminary identification of extrinsic evidence supporting Defendants’ responsive
`claim constructions. A chart identifying each claim term, preliminary proposed
`claim constructions, and supporting extrinsic evidence is found below.
`The identified responsive claim constructions are based on Defendants’
`analysis and investigation to date, as well as ongoing discovery. Defendants have
`not yet had the opportunity to take depositions, including of the named inventors.
`Defendants, thus, reserve all rights to alter or amend this disclosure. Defendants’
`identification of any claim term for construction is not an admission that a claim
`containing that term meets the requirements of 35 U.S.C. § 112. Defendants also
`reserve the right to propose responsive constructions for combinations of the terms
`and phrases below and to propose responsive constructions for shorter phrases
`contained in the phrases below.
