`RELATED MATTERS

`In parallel with this proceeding, Petitioner submitted a Petition for IPR of

`U.S. Patent No. 9,259,425 (“the ‘425 patent”) (IPR2022-00146), which was
`
`instituted and placed on the same schedule as this proceeding.
`
`Except as detailed above, to the best of Petitioner’s knowledge, the ‘425
`
`patent and the ‘742 patent have not been the subject of any prior Petition for IPR.
`
`Patent Owner has asserted the ‘742 patent in the following litigations:
`
`Bausch & Lomb Inc. et al. v. Slayback Pharma LLC et al., 3:21-cv-16766 (D.N.J.),
`
`and Bausch & Lomb, Inc. et al. v. Lupin Limited et al., 3:22-cv-00534 (D.N.J.).
`
`To the best of Petitioner’s knowledge, the ‘742 patent has not been asserted
`
`in any other litigations.
