`In accordance with Patent Rule 4-3 and the Court’s Docket Control Order of June 3, 2021

`(Dkt. No. 34), the parties to the above-captioned case provide the following Joint Claim
`
`Construction and Prehearing Statement regarding the asserted claims of U.S. Patent No. RE47,049
`
`(the “’049 patent”) and U.S. Patent No. RE48,371 (the “’371 patent”). In accordance with Patent
`
`Rule 4-2(c), the parties met and conferred for the purposes of narrowing the issues and finalizing
`
`preparation of this Joint Claim Construction Chart.

`I.

`The Parties expect that 3 hours will provide sufficient time to conduct the claim
`
`construction hearing.

`At the present time, no party proposes to call witnesses for live testimony at the claim

`construction hearing

`P.R. 4-3(a)(5) Other Issues to be Addressed Prior To the Claim Construction

`Hearing
`
`Amazon requests that the Court schedule a prehearing conference for oral argument on
`
`Amazon’s pending Motion to Dismiss First Amended Complaint (Dkt. No. 38). In that Motion,
`
`Amazon requests that the court dismiss this case in its entirety or stay the case pending a decision
`
`in a related Federal Circuit appeal. A decision to stay or dismiss this case could eliminate the need
`
`for any claim construction here. Amazon submitted an unopposed motion for a hearing on the
`
`Motion, but no hearing date has been set. (See Dkt. No. 48.) Amazon proposes that a prehearing
`
`conference, at which oral argument on Amazon’s Motion could be heard, be scheduled for
`
`September 21, 22, 28, or 29, or October 6, 12, or 13, so that the Court may consider whether to
`
`stay or dismiss this case prior to the claim construction hearing currently scheduled for November
`
`19, 2021. Proceeding with claim construction here while the Federal Circuit is considering
`
`overlapping, case-dispositive issues in the pending appeal is not an efficient use of resources for
`
`the Court or the parties.
