` 7 listening to testimony from ecobee co-founder,
`
` 8 Mr. Malchiondo.
`
` 9 Before we resume that testimony, why don't we
`
` 10 see if there are any housekeeping matters from the parties,
`
` 11 starting with counsel for the Complainant. Anything?
`
` 12 MR. EUTERMOSER: Yes, Your Honor, we would like
`
` 13 to admit our list of exhibits that were presented
`
` 14 yesterday. We will be sending that to the court reporter
`
` 15 shortly, if we haven't already. I understand that
`
` 16 Respondents have no objection to that.

`
` 4 Honor, the one shown on the left.
`

` 6 MS. PARSONS: So this one says the control power
`
` 7 message indicating at least one of either -- I'm inserting
`
` 8 the word "either" for example purposes -- either an amount
`
` 9 of electric power to be reduced and an identification of at
`
` 10 least one controllable device to be instructed to disable.
`
` 11 And I'll pause there.
`
` 12 So we see that as an either/or because it's
`
` 13 indicating at least one of. So the message either
`
` 14 identifies the amount of power to be reduced or it
`
` 15 indicates a controllable device. So that -- that is just
`
` 16 one additional distinction about the power control message
`
` 17 under Complainant's read of the infringement.
`
` 18 CHIEF JUDGE CHENEY: Okay. And are you relying
`
` 19 on one or the other of those?
`
` 20 MS. PARSONS: We're relying on both. But we
`
` 21 were specific in our proofs. Dr. Madisetti's infringement
`
` 22 analysis was specific with respect to the power control
`
` 23 messages.
