`The Parties have jointly filed a motion to terminate this proceeding pursuant
`
`to a settlement agreement between the Parties. Pursuant to the Board’s request as
`
`set forth in its email of December 19, 2022 and in accordance with 35 U.S.C.
`
`§317(b), the Parties have filed the settlement agreements as Exhibits 1059 and
`
`1060. The settlement agreements provide that the terms of the agreement are to be
`
`maintained as confidential by the Parties and, subject to certain exceptions, may
`
`not be disclosed to any third parties without the express written consent of the non-
`
`disclosing party.
`
`
`
`The Board has granted the Parties leave to file this motion to treat the
`
`settlement agreements as business confidential information. The Parties therefore
`
`jointly move pursuant to 37 C.F.R. § 42.74(c) that the settlement agreements,
`
`submitted as Exhibits 1059 and 1060, be treated as business confidential
`
`information and be kept separate from the files of the patent at issue in this
`
`proceeding.
