`
`
`With our authorization, Petitioner Ilooda Co., Ltd. and Patent Owner
`Serendia, LLC filed a joint motion to terminate Ilooda as a party in each of
`the above-identified proceedings pursuant to 35 U.S.C. § 317. See IPR2024-
`00383, Paper 10. 3 Along with the motion, Ilooda and Serendia filed a copy
`of a settlement agreement, which they request be treated as business
`confidential information pursuant to 37 C.F.R. § 42.74(c). Id. at 1 (citing
`Ex. 1026).
`In the motion, Ilooda and Serendia state that they have settled their
`dispute regarding the challenged patent in each of the above-identified
`proceedings and, on that basis, request that the proceedings be terminated as
`to Ilooda. Id. at 2–4. Each proceeding is in a preliminary stage, and we
`have yet to issue decisions on whether to institute trial. Under these
`circumstances, we determine it is appropriate to terminate these proceedings
`only as to Ilooda. See 35 U.S.C. § 317; 37 C.F.R. §§ 42.71(a), 42.74.
`Ilooda and Serendia also ask that their settlement agreement be treated
`as business confidential information and be kept separate from the files of
`the challenged patents. Paper 10, 4–5 (citing Ex. 1026). Pursuant to
`37 C.F.R. § 42.74(c), we determine that it is appropriate to treat the
`settlement agreement as business confidential information and keep it
`separate from the files of the challenged patents.
`
`
`3 For convenience, we cite only to papers and exhibits in IPR2024-00383,
`but substantially identical papers and exhibits are of record in each of the
`other proceedings.
