`
`(57) Abstract
`The invention concerns the production of a shoe upper by cutting out the upper, in the form of a pattern, from a strip of material
`and shaping the upper, at the same time joining parts of the upper by seams. The aim of the invention is to develop the method used
`so that, in spite of the large number of individual parts existing or to be made visible, such shoe uppers can be produced rationally
`and without waste of time. To this end, the invention proposes that, when the strip of material (1) is manufactured, the patterns (2) of
`the uppers are produced, at the same time as the strip of material (1) is produced, using different manufacturing techniques, such as
`different make-up, different yarn material, different color, different material thickness, single- or multi-layer material, etc., the patterns
`being cut from this strip and further worked to give shoe uppers.

`
`A method of producing a shaped shoe part from
`a material web and a shaped shoe part
`produced by this method
`
`The present invention relates to a method for producing a shaped shoe part from a material web according to
`the preamble of claim 1, and a shaped shoe part produced according to this method and according to the
`preamble of claim 13.
`
`A method according to the preamble of claim 1 is known from DE-PS 627 878. It discloses a material web
`produced such that it has three successive cross strips of different weaves. Patterns in the form of the U-
`shaped unwound web part of a shoe upper are printed on these cross strips. The cross strips are made such that
`the first one is suitable for the heel counter, the second one for the vamp and the side parts, and the third one
`for the toe cap, respectively. Thus, the second cross strip becomes elastic and multilayered, and the other two
`cross strips are produced in a non-elastic, durable manner. Stiffening threads may also be interwoven, and the
`cross strip for the heel counter may be made as a hollow fabric in which a heel cap may be inserted. The U-
`shaped parts are cut from the fabric, sewn together on the open U-side, which forms the heel counter, after
`which a sole is attached in a manner not described in more detail.
`

`IPR Petition - USP 8,266,749
`
`
`
`In contrast, the present invention is intended to achieve the object of further developing this prior-art method
`such that a shoe upper together with the associated sole part can be designed in many different ways, e.g., with
`strip-shaped markings, embellishments, and the like, yet making the production of such a shoe upper possible
`in an efficient and cost-effective manner.
`
`This object is achieved by the method steps specified in the charactering part of claim 1 and the features
`described in the characterizing part of claim 13.
`
`With the method according to the invention only those parts of the material web corresponding to the pattern
`or an area of a pattern of the shoe upper or the associated sole part are produced in the required quality,
`thickness, multilayered, or the like. However, the remaining area of the material web may be of a simple,
`lightweight or inexpensive fabric quality, which merely holds together the patterns or areas of such patterns in
`the material web after its completion. Thus, the offcut resulting from the cutting represents a simple, light and
`cheap fabric. In contrast thereto, in the case of the known fabric with cross strips, the whole offcut consists,
`e.g., of an elaborate hollow fabric, multilayer fabric, and the like.
`
`A further advantage of the method according to the invention is that the individual patterns or partial patterns
`can already be produced directly during the production of the material web in the desired shoe size, whereby
`the amount of offcut can be further reduced, in that the individual patterns or partial patterns can be directly
`connected to one another in the intended size. Nevertheless, it is possible to design the individual patterns or
`partial patterns to be soft, rigid, elastic, of different color, etc., depending on the subsequent stress or desired
`shape. Only inner and/or outer stiffening elements, such as inner and/or outer toe caps, heel caps and the like,
`need to be subsequently fitted.
`
`When using program-controlled, fabric-web production units, the size of the unwound web part corresponding
`to the subsequent shoe size, the weave or knit type of individual areas or contours, the type of thread or fiber
`and/or the color can be selected almost freely after the program has been created once. Thus, only a small
`number of individual parts need to be produced separately and subsequently attached to the upper.
`
`Further advantageous details of the invention are given in the dependent claims and are described in more
`detail below with reference to the embodiments shown in the drawing. In the drawings:

`Fig. 4

`according to Figs. 1 and 2,
`
`shows a detail of a material web with an unwound web part with sole part sections provided on
`either side, including a tongue, and
`
`shows a detail of a material web with an unwound web part having a forefoot sole subsection
`on one side and a rearfoot or heel part sole subsection on the other side.
`
`
`In Figs. 1 and 2, 1 indicates a material web which, during its production by a method customary in the textile
`industry, e.g., by weaving and/or knitting and/or embroidery, is provided with a single or a plurality of
`unwound web part(s) 2 for the shoe-upper shape 3, as shown, e.g., from the side in Fig. 3.
`
`
`Fig. 5
`
`The material web base 4 may be a common woven or knitted fabric, e.g., consisting of warp and weft. The
`unwound web part 2 is divided into different individual parts or areas, which are distinguished from each
`other by a different type of fabric and/or by different fibers or threads, e.g., of wool, wool with metal threads,
`silk, silk with metal threads or wool with synthetic fibers, and the like, and/or by different colors of the fibers
`or threads, including metal threads, or by different color prints and/or differently formed fiber strands or fiber
`strand compositions, such as twisted, processed in parallel, and the like.
`
`The individual parts or areas of the shoe upper 3 may be representations of such areas onto which a trim, for
`example a wear-resistant part, is applied. For example, areas 5 and 6 are provided for an inner or outer heel
`cap 9 (Fig. 3) to be applied. After cutting out the unwound web part 2 from the material web 1, the edges 7
`and 8 are sewn together, such that a heel seam is formed. The heel cap 9 shown in Fig. 3 is then applied, e.g.,
`glued and/or sewn, to the now adjacent areas 5 and 6.
`
`Accordingly, on the toe of the shoe 10, the contours in the form of edges 11 and 12 are sewn together and a
`seam is formed at the toe of the shoe. To reduce wear, a toe cap 15 shown in Fig. 3 can be attached, in
`particular glued and/or sewn, to the front area adjacent to the front edge 13 of the toe area 14.
`
`Since, as a rule, the toe area 14 is to be designed to be relatively pliable, soft or elastic, and optionally also air-
`permeable, the material web 1 in the toe area 14 is appropriately formed according to the invention via the
`weave type, knit type and/or via a suitable selection of the material used, such as silk or plastic. Moreover, the
`production method may be such that the toe area 14 has an advantageous air exchange capability.
`
`This can be achieved, e.g., by a mesh-like fabric or a knitted structure.
`
`The areas denoted by positions 16 and 17 represent individual parts used for marking purposes, such as the
`"mold strip" marking by the applicant, which is well known in the art.
`
`-5-

`IPR Petition - USP 8,266,749
`
`
`
`The areas 20, 21 and 22 designated in Fig. 3, which extend from the instep area 18 to the heel area 19, may be
`designed in the form of tension bands and/or be produced in a particularly tensile-resistant manner. These
`shoe-upper areas can be specially designed during the production of the material web 1 by applying suitable
`means in order to obtain the desired effects. For example, particularly high-tensile fibers or filaments may be
`used here. If necessary, the fabric can be double- or multi-layered or particularly thickly woven or knitted, or
`additionally embroidered.
`
`The lacing areas 23 and 24 may be produced to be similarly dimensionally stable, especially if, for example,
`no additional trimmings in the form of lacing strips are to be applied, as provided in Fig. 3.
`
`Finally, in the exemplary embodiments according to Figs. 1 and 2, areas 26 and 27 are produced when making
`an unwound web part from the material web 1 in a shape, color or design, which is different from the other
`areas, and onto which a heel cap 28 shown in Fig. 3 is attached after the heel seam described at the beginning
`has been formed.
`
`As can be seen, any number of unwound web part(s) 2 can be produced from a material web 1 in a wide
`variety of configurations and/or designs, including in different sizes. Program-controlled, in particular
`computerized, fabrication equipment is particularly suitable for this purpose, whereby the type of fabrication,
`color, design, size and the like can be varied in a desirable fashion.
`
`According to an advantageous development of the invention, an individual part 29 in the form of an insole can
`also be produced by the unwound web part 2 for the shoe upper 3. After being cut out, this individual part 29
`remains connected to the unwound web part 2 and, after or during the shaping and fixation of the shoe
`upper 3, is folded out of the unwound web part 2 into the plane of the shoe sole and fixed to the lower edge
`area of the shoe upper 3, which is defined by the outer contours 30 and 31 of the unwound web part 2, in a
`per-se known manner, e.g., by gluing, sewing, stitching, and the like.
`
`During the production of the material web 1 or after its production and, if applicable, after the unwound web
`part(s) 2 has/have been cut out a, the unwound web part(s) 2 can be provided at suitable or preferred locations
`with embroidery, e.g., perforated embroidery, with a company logo, or some other mark or identification.
`Finally, a tongue 32 (Fig. 3) can be attached in the forefoot area before or after the unwound web part(s) 2
`have been cut out. After production of the shoe upper 3, an insole and/or a midsole is additionally attached or
`molded on, if necessary.
`
`The finished shoe upper 3 is then placed in an adhesive, injection or casting mold, in which a midsole 33 and
`an outsole 34 are formed by known methods, as shown in Fig. 3.
`
`The advantages of the method according to the invention described thus far are to be seen in particular in that
`up to 7 different textile fibers or threads and an equal number of colors can be introduced, in particular woven
`into the material web in one operation with a fully optimized weaving machine. As already indicated, any
`sizes and different shoe-upper designs can be produced by computerized programs, starting from
`corresponding basic patterns. The finished shoe uppers made from material webs are characterized by an
`
`-6-

`lululemon Ex. 1005
`IPR Petition - USP 8,266,749
`
`
`
`extremely low weight, e.g., between 70 to 80 grams for a shoe size 8. The costs of producing such shoe-upper
`parts are remarkably low compared with previously known methods.
`
`In Figs. 1 and 2, the numeral 11 indicates unworked surface areas located outside of the unwound web part 2
`for the shoe upper 3 and the tongue 40, respectively.
`
`According to an advantageous development of the invention, the sole part 29, which is embodied as a sole part
`29 and shown as a component part in Figs. 1 and 2, may be split lengthwise, crosswise or diagonally and thus
`embodied in two or more parts, wherein at least one sole part section is provided on each outer contour 30, 31
`of an unwound web part 2.
`
`In the exemplary embodiment according to Fig. 4, a sole part section 29.1 extending over the entire length of
`the subsequent sole is provided on the outer contour 31 in the form of roughly half of the sole part 29, and a
`sole part section 29.2 forming the remainder of the sole part 19 is provided on the outer contour 30. Both sole
`part sections 29.1 and 29.2 complement one another so as to form the complete sole part 29. In this case, their
`outer contours 29.3 and 29.4 are preferably joined together by a longitudinal seam, e.g., sewn and/or glued
`and/or welded, and the like.
`
`In the exemplary embodiment according to Fig. 5, a forefoot sole part section 29.5 is provided on the outer
`contour 31 of the unwound web part 2 for the shoe upper 3, and a heel sole part section 29.6 is provided on the
`outer contour 30. Their outer contours 29.7 and 29.8 facing the center of the shoe upper 2 are later joined
`together to form the whole sole part 29. The resulting seam extends crosswise, diagonally, or diagonally and
`approximately S-shaped, or the like, according to the design of the outer contours 29.7 or 29.8. The course of
`this seam is preferably chosen such that it cannot exert any pressure, or at least no uncomfortable pressure, on
`the foot sole.
`
`What’s more, e.g., according to Fig. 4, a tongue 40 may also be provided with different weave structures
`and/or weave patterns and/or embroidery or with one or more prints, and the like, while producing the
`material web 1. Different tongues 40 may be produced on a material web 1 according to a shoe shape and/or a
`shoe size, both in terms of shape, size, color(s), patterns, and the like. Preferably, the associated tongues 40
`are produced immediately along with an unwound web part 2 on the same material web 1.
`
`For optimum utilization of the material web 1 area, a tongue 40 can be produced in the open space 41 between
`the two unwound web part sections 42 and 43, which subsequently form the rear foot or heel part of the shoe.
`
`Preferably, each unwound web part 2 has at least five, preferably more than ten, and a tongue 40 at least two,
`preferably at least three, patterns made differently or looking different from one another.
`
`In an advantageous further embodiment of the invention, the material web 1 is produced such that its surface
`areas 1.1, in which no unwound web part(s) 2 or tongue(s) 40 are provided, consist of a lightweight fabric
`quality being as simple and inexpensive as possible. For example, these surface areas 1.1 can be produced in
`the manner of a gauze or with a low to very low number of warps and/or wefts and/or, e.g., thin-threaded or
`
`-7-

`
`
`
`the like. This ensures particularly efficient production of molded shoe parts, such as shoe uppers or shoe
`uppers in conjunction with soles and/or tongues, and the like.
`
`Preferably, areas of the unwound web part(s) 2, of the sole parts 29, in particular of the sole part sections 29.1
`and 29.2 or 29.5 and 29.6, can have a textile proportion of material that absorbs moisture well. Cotton is
`preferably used for this purpose. The proportion of absorbent material is at least about 25% of the total
`material. Depending on the application, this proportion can be increased up to 100%.
`
`As already indicated, the material webs to be used can be produced by computerized web material production
`equipment, whose programs, according to the appropriate default setting, can be adjusted almost freely in case
`of deviations in the size of the unwound web part of the individual shoe uppers or in case of changes in the
`weave or knit of individual areas or contours, the type of thread or fiber, and/or color.

To this end, the invention proposes that, when the strip of material (1) is manufactured, the patterns (2) of
`the uppers are produced, at the same time as the strip of material (1) is produced, using different manufacturing techniques, such as
`different make-up, different yarn material, different colour, different material thickness, single- or multi-layer material, etc., the
`patterns being cut out from this strip and further worked to give shoe uppers.

`Zur Herstellung eines Schuhschaftes durch Heraustrennen des Schuhschaftes in Form einer Abwicklung
`(57) Zusammenfassung
