`I, Steve Venuti, do hereby declare and state:

`I am a citizen of the United States, and reside in Milpitas, California.

`I make the following statements in this declaration based on my
`
`personal knowledge.

`I first joined HDMI Licensing, LLC (“HDMI Licensing”), which is
`
`now HDMI Licensing Administrator, Inc., in September 2002. I retired from HDMI
`
`Licensing in March 2015. At the time of my retirement, I was serving as President
`
`of HDMI Licensing, a role that I had been in since April 2008. Prior to being
`
`President, from September 2005 to March 2008, I was the Vice President of
`
`Marketing of HDMI Licensing. From September 2002 to September 2005, I did not
`
`have an official title but worked in a marketing role to build a brand around HDMI
`
`by marketing the HDMI Specification.
`

`This declaration relates to the publication and public accessibility of
`
`versions 1.0, 1.1, 1.3, and 1.3a of the HDMI Specification (generally, the “HDMI
`
`Specification”). A true and correct copy of versions 1.0, 1.1, 1.3, and 1.3a are
`
`attached to this declaration as Attachments A, J, B, and C, respectively. The HDMI
`
`Specification generally defines the features and functionality required to implement
`
`HDMI-compliant interfaces.
`

`HDMI Licensing released the HDMI 1.0 Specification on December 9,
`
`2002. This release was announced in a press release dated December 9, 2002. A

`copy of that press release is contained in Attachment L (obtained from
`
`https://hdmi.org/press/bodydetails/79). At that time, I was serving in the role of
`
`marketing HDMI by marketing the HDMI specification for HDMI Licensing. The
`
`HDMI 1.0 Specification generally relates to an interface for transmitting digital
`
`audiovisual signals that can carry high quality multi-channel audio data, can carry
`
`all standard and high definition consumer electronics video formats, and can also
`
`carry control and status information in both directions.
`

`HDMI Licensing released the HDMI 1.1 Specification on May 20,
`
`2004. At that time, I was continuing to serve in the role of marketing HDMI by
`
`marketing the HDMI specification for HDMI Licensing. The HDMI 1.1
`
`Specification generally relates to an interface for transmitting digital audiovisual
`
`signals that can carry high quality multi-channel audio data, can carry all standard
`
`and high definition consumer electronics video formats, and can also carry control
`
`and status information in both directions.
`

`
`HDMI Licensing released the HDMI 1.3 Specification on June 22,
`
`2006, and released the HDMI 1.3a Specification on November 10, 2006. At the time
`
`of those releases, respectively, I was the Vice President of Marketing of HDMI
`
`Licensing. The HDMI 1.3 Specification generally relates to an interface that
`
`combines uncompressed high-definition video, multi-channel audio, and data in a
`
`single digital interface to provide crystal-clear digital quality over a single cable.

`The HDMI 1.3a Specification includes minor updates to the HDMI 1.3
`
`Specification. Attachment D supports, and is consistent with, my recollection that
`
`version 1.3a of the HDMI Specification contains only minor revisions to version 1.3.
`
`Attachment D is the Internet Archive WayBack Machine copy of the December 17,
`
`2008, version of the hdmi.org FAQ page. Attachment D explains that “[f]or
`
`consumers, there is no difference between HDMI version 1.3 and 1.3a….These
`
`minor revisions to the specification typically relate to manufacturing or testing issues
`
`and do not impact features or functionality.” Attachment D at 2.

`Since November 2002, HDMI Licensing has been the licensing agent
`
`responsible for administering the licensing of the HDMI Specification, promoting
`
`HDMI technology, and providing education on the benefits of the HDMI interface
`
`to retailers and consumers.
`

`In my marketing role for marketing the HDMI Specification at HDMI
`
`Licensing, starting in September 2002, I was personally involved in promoting the
`
`adoption of version 1.0 of the HDMI Specification, and thus I am personally
`
`knowledgeable about the contents of this version. One of my responsibilities in that
`
`role was to encourage the adoption of version 1.0 of the HDMI Specification by
`
`consumer electronics and PC manufacturers worldwide, and I am personally
`
`knowledgeable about those efforts.

`To encourage adoption of version 1.0 of the HDMI Specification,

`HDMI Licensing made the announcement available everywhere informing
`
`interested members of the public that version 1.0 was available to interested
`
`members of the public by way of the website at http://hdmi.org as of its release date
`
`of December 9, 2002. See Attachment L (“Parties interested in designing HDMI-
`
`based products may access the HDMI 1.0 Specification at www.hdmi.org.”). I was
`
`personally responsible for the promotion of the HDMI 1.0 Specification, including
`
`by way of its distribution on the hdmi.org website, and thus have personal
`
`knowledge that the HDMI 1.0 Specification was available on http://hdmi.org to
`
`interested members of the public at least as of December 9, 2002.
`
`11. Attachments E1 and E2 support, and are consistent with, my
`
`recollection that the HDMI 1.0 Specification was accessible to the public as of its
`
`December 9, 2002 release. Attachment E1 is the Internet Archive WayBack Machine
`
`copy of the February 1, 2003, version of the hdmi.org download instructions page1
`
`for the HDMI 1.0 Specification. Attachment E2 is the Internet Archive WayBack
`
`Machine copy of the February 2, 2003, version of the hdmi.org download page2 that
`

`was presented upon the user clicking on the “1.0 Spec” link shown in the download
`
`instructions page in Attachment E1. As indicated in Attachment E1, dated February
`
`1, 2003, “Version 1.0 of the HDMI specification is now available for download.
`
`Follow the steps below to gain access to the spec.” As indicated in Attachment E1,
`
`interested members of the public only needed to submit two signed copies of an
`
`adopter agreement and make an annual fee payment to obtain a login name and
`
`password from HDMI Licensing that would allow them to download the HDMI 1.0
`
`Specification. There were no other restrictions imposed on members of the public
`
`from accessing a copy of the HDMI 1.0 Specification. As indicated in Attachment
`
`E2, dated February 2, 2003, users would then enter their login name and password
`
`to download the HDMI 1.0 Specification from the website.
`
`12. Attachment A contains a true and correct copy of version 1.0 of the
`
`HDMI specification, as initially released on December 9, 2002, and is a copy that I
`
`obtained from my archives that I maintained while I was employed by HDMI
`
`Licensing.
`
`13. As shown in Attachment A, the HDMI 1.0 Specification included a
`
`“Confidential” footer at the time of its initial release. This footer was included
`
`merely to indicate that the HDMI 1.0 Specification was not to be distributed to
`
`individuals who had not signed the adopter agreement and paid the annual fee. As
`
`discussed, there were no other restrictions imposed on availability of the HDMI 1.0

`Specification to interested members of the public. And this “Confidential” footer
`
`did not indicate that this was a confidential document internal to HDMI Licensing.

`In my marketing role for marketing the HDMI Specification at HDMI
`
`Licensing, starting in September 2002, I was also personally involved in promoting

`the adoption of version 1.1 of the HDMI Specification, and thus I am personally
`
`knowledgeable about the contents of this version. One of my responsibilities in that
`
`role was to encourage the adoption of version 1.1 of the HDMI Specification by
`
`consumer electronics and PC manufacturers worldwide, and I am personally
`
`knowledgeable about those efforts.

`have personal knowledge that the HDMI 1.1 Specification was available on
`
`http://hdmi.org to interested members of the public at least as of May 20, 2004.

`16. Attachment K is consistent with my recollection that the HDMI 1.1
`
`Specification was accessible to the public as of its May 20, 2004 release. Attachment
`
`K is the Internet Archive WayBack Machine copy of the June 12, 2004, version of

`the hdmi.org download instructions page3 for the HDMI 1.1 Specification. As
`
`indicated in Attachment K, dated June 12, 2004, “Version 1.1 of the HDMI
`
`Specification [is] available for download. In order to gain access to either of these
`
`specifications please register by filling out the form below.” As shown in
`
`Attachment K, all interested members of the public had to do to be able to download
`
`the HDMI 1.1 Specification as of its release was to complete a form requesting
`
`biographical information from the user, such as name, title, phone number, email
`
`address, company, job function, etc. As Attachment K also indicates, once users
`
`submitted the form, they were able to download the HDMI 1.1 Specification for free.
`
`Attachment K (“Once you submit your completed form, you will be able to choose
`
`to download [] Version 1.1 of the HDMI Specification (FREE DOWNLOAD) . . .
`
`.”). There were no other restrictions imposed on members of the public from
`
`accessing a copy of the HDMI 1.1 Specification. It merely required entry of basic
`
`information identifying the downloader. Activating the submit button would then
`
`provide a link from which the HDMI Specification could be directly downloaded. I
`
`was personally responsible for coordinating the development of this download
`
`functionality.

`In my role as Vice President of Marketing of HDMI Licensing from

`September 2005 through March 2008, I was personally involved in promoting the
`
`adoption of versions 1.3 and 1.3a of the HDMI Specification, and thus I am
`
`personally knowledgeable about the contents of these versions. One of my
`
`responsibilities in that role was to encourage the adoption of versions 1.3 and 1.3a
`
`of the HDMI Specification by consumer electronics and PC manufacturers
`
`worldwide, and I am personally knowledgeable about those efforts.
`

`To encourage adoption of versions 1.3 and 1.3a of the HDMI
`
`Specification, HDMI Licensing made these versions freely available by way of the
`
`website at http://hdmi.org. I was personally responsible for the promotion of the
`
`HDMI 1.3 and 1.3a Specifications by way of their distribution on the hdmi.org
`
`website, and thus have personal knowledge that the HDMI 1.3 Specification was
`
`available on that website at least as of June 22, 2006 (when that version was
`
`released), and the HDMI 1.3a Specification was available on that website at least as
`
`of November 10, 2006 (when that version was released).

`20. Attachment F supports, and is consistent with, my recollection that the
`
`HDMI 1.3 Specification was accessible to the public as of June 22, 2006. Attachment

`F is the Internet Archive WayBack Machine copy of the July 1, 2006, version of the
`
`hdmi.org download page4 for the HDMI Specification. As noted above, by that time,
`
`the current version of the HDMI Specification was 1.3 and that version was available
`
`for download from the hdmi.org download page. Attachment F explains that “[t]he
`
`HDMI technical specification is available to HD device, display, component, and
`
`test equipment manufacturers at no charge.” With respect to version 1.3, that
`
`statement is accurate, and was accurate as of June 22, 2006, when the HDMI 1.3
`
`Specification was released. All that interested members of the public had to do to
`
`be able to download the HDMI 1.3 Specification was to complete the form
`
`requesting biographical information about the user, as indicated in Attachment F.
`

`HDMI specification, as initially released on November 10, 2006, and is a copy that
`
`I obtained from my archives that I maintained while I was employed by HDMI
`
`Licensing.

`To encourage the adoption of the HDMI 1.0, 1.1, 1.3 and 1.3a
`
`Specifications, HDMI Licensing allowed the public, as of December 9, 2002, May
`
`20, 2004, June 22, 2006, and November 10, 2006, respectively, to access the HDMI
`
`1.0, 1.1, 1.3, and 1.3a Specifications via that website and download a copy. HDMI
`
`Licensing intended for the HDMI 1.0, 1.1, 1.3, and 1.3a Specifications to be
`
`distributed as widely as possible and thus placed no restrictions on such downloading
`
`or on the redistribution of the specification other than those specifically listed above.
`
`25.
`
`Part of my responsibilities at HDMI Licensing was to make the relevant
`
`public aware of versions 1.0, 1.1, 1.3, and 1.3a of the HDMI Specification and their
`
`availability. We did this through several mechanisms—for example, through a tab
`
`on the hdmi.org website, through press releases, and through promotion of the
`
`availability of the versions of the HDMI Specification at industry events such as
`
`CES and DisplaySearch, as well as at HDMI Licensing press events.
`

`In my role of encouraging the adoption of versions 1.0, 1.1, 1.3, and
`
`1.3a of the HDMI Specification, I communicated with representatives from
`

`consumer electronics and personal computer manufacturers who were interested in
`
`using the HDMI Specification to implement audiovisual interfaces in their products.
`
`27. Around the time that versions 1.3 and 1.3a of the HDMI specification
`
`were released, there were already hundreds of HDMI adopters. Attachments H and
`
`I support, and are consistent with, my recollection concerning the number of HDMI
`
`adopters in the 2006 timeframe. Attachments H and I are Internet Archive WayBack
`
`Machine copies of the July 1, 2006, and November 29, 2006, versions of the
`
`hdmi.org adopters and founders page. As of July 1, 2006, this page listed 425
`
`adopters. Attachment H. By November 29, 2006, this page listed 485 adopters,
`
`including many prominent consumer electronics manufacturers. Attachment I.
`

`I am also personally aware of a number of people outside of HDMI
`
`Licensing, including at various manufacturers, who were aware of the availability of
`
`version 1.0 of the HDMI Specification on the hdmi.org website in the late 2002 and
`
`early 2003 timeframe after its release and who actually downloaded the HDMI
`
`Specification from the website. I am also personally aware of a number of people
`
`outside of HDMI Licensing, including at various manufacturers, who were aware of
`
`the availability of version 1.1 of the HDMI Specification on the hdmi.org website
`
`May 2004 timeframe after its release and who actually downloaded the HDMI
`
`Specification from the website. I am also personally aware of a number of people
`
`outside of HDMI Licensing, including at various manufacturers, who were aware of

`Sometime in 2007, I personally made a request within HDMI Licensing
`
`for the number of downloads of the HDMI Specification from the hdmi.org website
`
`and learned that there had been more than 30,000 downloads of the HDMI 1.0-1.3a
`
`specifications as of that time in 2007.
`
`30. As I discuss above, I was employed by HDMI Licensing until March
`
`2015. In March 2015, I retired from my role as president of HDMI Licensing—a
`
`role I had held since April 2008. As president of HDMI Licensing, I would have
`
`viewed a dispute between Universal Connectivity Technologies, Inc. and HP, Dell,
`
`and Lenovo as a neutral event, and, as a matter of policy, would not have become
`
`involved without being issued a Court subpoena or similar legal document. At that
`
`time, I would not have provided, nor would I have authorized another HDMI
`
`Licensing employee to provide, a declaration such as this one.

`I understand that in the current proceeding I may be deposed on the
`
`contents of this declaration, if requested, and I am willing to sit for any such
`
`deposition. I am being paid a flat fee of $2,500 for my time in connection with
`
`preparing this declaration, and an hourly fee of $500/hour for my time in connection
`
`with participating in any deposition in this proceeding. My compensation is in no
