`I am submitting this declaration in connection with Bestway (USA),

`Inc.’s Petition for Post-Grant Review of U.S. Patent No. 9,254,240. I understand

`that Bestway (USA), Inc., Bestway Global Holdings, Inc., Bestway (Hong Kong)

`International, LTD., Bestway Inflatables & Materials Corp., Bestway (Hong Kong)
`
`Enterprise Co. Ltd., and Bestway (Nantong) Recreation Corp. (collectively,
`
`“Bestway”) are listed as the real parties-in-interest.

`I am Chief Executive Officer (“CEO”) of Bestway (USA), Inc. I have
`
`worked for Bestway for the last 18 years. Prior to becoming CEO of (USA), Inc.,
`
`I served as CEO of Bestway (Europe) S.r.l. (“Bestway-Europe”). I served as CEO
`
`of Bestway-Europe for 13 years. As CEO of Bestway-Europe, I was responsible
`
`for product development and marketing. My duties included supervising the
`
`creation and design of Bestway’s product catalogs, approving catalog mock-ups
`
`and content, and overseeing the publishing and distribution of those catalogs.
`

`Appendix A to this declaration is an electronic copy of excerpts from
`
`Bestway’s 2009 Above Ground Pools catalog. I have personally reviewed

`Appendix A and attest that it is a true and correct copy of the excerpts from the

`catalog. I also have personal knowledge that the 2009 Above Ground Pools
`
`catalog was created by Bestway in 2008 and was publicly distributed by Bestway
`
`during 2008-09 in the course of its regularly conducted business activities.

`Appendix B to this declaration is an electronic copy of excerpts from
`
`Bestway’s 2009 Summer Inflatables catalog. I have personally reviewed Appendix
`
`B and attest that it is a true and correct copy of the excerpts from the original,
`
`printed 2009 Summer Inflatables catalog, as kept, maintained, and distributed by
`
`Bestway in the course of its regularly conducted business activities. I have
`
`personal knowledge of the contents of Bestway’s 2009 Summer Inflatables. I also
`
`have personal knowledge that the 2009 Summer Inflatables catalog was created by
`
`Bestway in 2008 and was publicly distributed by Bestway during 2008-09 in the

`course of its regularly conducted business activities.

`Starting in approximately May 2008, Bestway began printing the 2009

`Above Ground Pools and 2009 Summer Inflatables catalogs and it by mid-2009 it
`
`had shipping numerous hard copies of the 2009 Above Ground Pools and 2009
`
`Summer Inflatables catalogs to wholesalers and retailers around the world.

`Since the first printing in 2008, Bestway has maintained, and
`
`continues to maintain, a hard copy archive of the 2009 Above Ground Pools and
`
`2009 Summer Inflatables catalogs at its offices in Shanghai, China, in the course of
`
`Bestway’s regularly conducted business activities.
`

`The 2009 Above Ground Pools and 2009 Summer Inflatables catalogs
`
`catalog bears a copyright date stamp of 2008. Based on my knowledge of and
`
`experience with Bestway’s copyright marking practices, this date means that the
`
`2009 Above Ground Pools and 2009 Summer Inflatables catalogs was printed,
`
`distributed, and widely disseminated at least by mid-2009.
`

`The 2009 Above Ground Pools and 2009 Summer Inflatables catalogs
`
`were available to Bestway customers and wholesalers upon request. Bestway
`
`printed nearly 10,000 copies of the the 2009 Above Ground Pools and 2009
`
`Summer Inflatables catalogs and distributed those copies to customers and other
`
`recipients worldwide. These recipients included hundreds of customers located in
`
`China, Hong Kong, Japan, Israel, Germany, Saudi Aribia, United Kingdom, Italy,
`
`Spain, France, Bulgaria, Slovakia, Panama, Poland, Peru, Canada, Russia,
`
`Argentina, Brazil, Finland, Australia, Mexico, and the United States. Persons
`
`seeking a copy of the 2009 Above Ground Pools and 2009 Summer Inflatables
`
`catalogs from May 2008 through June 2009 could have obtained such a copy from
`
`Bestway by request by contacting any Bestway branch office worldwide.
