`On July 21, 2017, Petitioner Telebrands Corp (“Telebrands”) filed a Petition
`
`PGR2017-00040
`U.S. Patent No. 9,682,789
`
`
`
`for Post Grant Review of U.S. Patent No. 9,682,789, seeking cancellation of all
`
`twenty-three (23) claims as unpatentable under 35 U.S.C. §§ 112 and 103.
`
`Pursuant to 37 C.F.R. 42.15(b), Telebrands paid a Petition fee of $12,000, a
`
`Post-Institution fee of $18,000, and an excess claims fee of $5,150 at the time of
`
`filing its Petition. The excess claims fee of $5,150 included a request fee of $750
`
`for review of three (3) claims over twenty (20), and a Post-Institution fee of $4,400
`
`for review of eight (8) claims over fifteen (15). The fees were charged to deposit
`
`account number 03-3125.
`
`On February 7, 2018, the Board denied Telebrands’ Petition, and no trial was
`
`instituted. (Paper No. 10). Accordingly, Telebrands hereby requests refund of its
`
`Post-Institution fee in the amount of $18,000 and $4,400, for a total of $22,400 to
`
`be paid to deposit account number 03-3125.
