`Joint Motion to Terminate and to Seal
`PGR2017-00042 (U.S. Patent No. 9,493,892)

`Pursuant to 35 U.S.C. § 327(a) and 37 C.F.R. § 42.74(a), Petitioner AQ
`
`Textiles, LLC ("AQT") and Patent Owner Arun Agarwal ("Agarwal") hereby
`
`jointly request that the Board teiniinate the post grant review of U.S. Patent No.
`
`9,493,892, Case No. PGR2017-00042.
`
`Pursuant to 35 U.S.C. § 327(b) and 37 C.F.R. § 42.74(b), in connection with
`
`such termination, the parties attach a true copy of their Settlement Agreement as
`
`Exhibit 2003. The Parties also attach a Strategic Alliance Agreement and a License
`
`Agreement as Exhibits 2004 and 2005, respectively. Pursuant to 35 U.S.C.
`
`§ 327(b), 37 C.F.R. § 42.74(c), and 37 C.F.R. § 42.14, the parties request that the
`
`Settlement Agreement, the Strategic Alliance Agreement, and the License
`
`Agreement be treated as business confidential infoil lation and kept separate from
`
`the file of the involved patent.
`
`AQT's and Agarwal's request that the proceeding be terminated without
`
`rendering a final written decision is appropriate at least because the trial is in its
`
`preliminary stages, and neither party has had an opportunity to present evidence
`
`and arguments in the trial phase of the proceeding. 35 U.S.C. § 327; 37 C.F.R. §
`
`42.74.
