`
`DETAILED ACTION
`
`1.
`
`The present application, filed on or after March 16, 2013, is being
`
`examined under the first inventor to file provisions of the AIA.
`
`2.
`
`This communication is in response to Application No. 15/686,268 filed on
`
`08/25/2017.
`
`3.
`
`Claims 1-15 are currently pending and have been examined.
`
`• 4.
`
`This application is a continuation of U.S. application No. 15/391, 123
`
`filed on 12/27/2016 now U.S Patent 9,770,659 See MPEP 201.07. In
`
`accordance with MPEP 609.02 A.2 and MPEP 2001.06 (b) (last
`
`paragraph), the Examiner has reviewed and considered the prior art cited
`
`in the Parent Application. Also in accordance with MPEP 2001.06 (b) (last
`
`paragraph), all documents cited or considered 'of record' in the Parent
`
`Application are now considered cited or 'of record' in this application.
`
`Additionally, Applicant(s) are reminded that a listing of the information
`
`cited or 'of record' in the Patent Application need not be resubmitted in this
`
`application unless Applicants desire the information to be printed on a
`
`patent issuing from this application. See MPEP 609.02 A. 2. Finally,
`
`Applicants are reminded that the prosecution history of the Patent

`
`Information Disclosure Statement
`
`5.
`
`I OS filed 08/25/2017 is considered.
`
`Claim Rejections - 35 USC § 101
`
`6.
`
`35 U.S.C. 101 reads as follows:
`
`Whoever invents or discovers any new and useful process, machine, manufacture, or
`
`composition of matter, or any new and useful improvement thereof, may obtain a patent
`
`therefor, subject to the conditions and requirements of this title.
`
`7.
`
`Claims 1-15 are rejected under 35 U.S.C. 101 because the claimed invention is
`
`directed to a non-statutory subject matter. Specifically the claims are directed towards
`
`an abstract idea.
`
`8.
`
`Analysis based on Examination guidelines
`
`STEP 1 : Statutory Categories
`
`Is the claim directed to a process, machine, manufacture, or composition of
`
`matter?
`
`Yes according to MPEP 2106(1), claims 1-15 are directed to one of the four
`
`patent-eligible subject categories.
`
`STEP 2: Judicial Exceptions
`
`STEP 2A: Is the claim directed to "laws of nature, natural phenomena,
`
`and abstract ideas".
`
`9
`
`

`

`Application/Control Number: 15/686,268
`Art Unit: 3716
`
`Page 4
`
`Yes the claims are directed to an abstract idea because claims 1-15 are directed
`
`to a method for performing a data storage function.
`
`Since an abstract idea is present in the claim, the analysis continues to STPE
`
`2B.
`
`STEP 28: If an abstract idea is present in the claim, it must be determined
`
`whether any element or combination of the elements, in the claim is sufficient to ensure
`
`that the claim amounts to significantly more than the abstract idea itself. In other words,
`
`are there other limitations in the claim that show a patent-eligible application of
`
`the abstract idea, e.g., more than a mere instruction to apply the abstract idea?.
`
`Limitations referenced in the Alice Corp. that may be enough to qualify as
`
`"significantly more" when recited in a claim with an abstract idea include:
`
`Improvements to another technology or technical field
`
`•
`
`Improvements to the functioning of the computer itself
`
`• Meaningful limitations beyond generally linking the use of an abstract idea
`
`to a particular technological environment.
`
`•
`
`In the instant case, the claims do not include additional elements that are
`
`sufficient to amount to significantly more than the judicial exception
`
`because it is unclear who is performing the steps recited in the claims. A
`mi~li!l~i~li~il~i in order to perform the steps. The claim also recite
`
`the step of "a data storage function of storing ... , a control function of
`
`receiving ... ," which do not add meaningful limitations of" performing a
`
`data storage function" beyond generally linking the system to a particular
`
`10
`
`

`

`Application/Control Number: 15/686,268
`Art Unit: 3716
`
`Page 5
`
`technological environment, that is, implementation via machine or device.
`
`The claims do not amount to significantly more that the underlying
`
`abstract idea of" displaying the panel as a moving character according to
`
`the information of motion associated with the panel when the panel is
`
`disposed in a target division". Accordingly, claims 1-15 are ineligible.
`
`• For example, claim 1 does not have "a machine" for performing the
`
`claimed functions. It is to be noted that in order to achieve the steps recite
`
`in the claims, a machine is needed. Therefore, the Applicant does not
`
`demonstrate that the claims are truly drawn to a specific apparatus distinct
`
`from other apparatus capable of performing the identical functions.
`
`• Double Patenting
`
`• 9.
`
`The nonstatutory double patenting rejection is based on a judicially
`
`created doctrine grounded in public policy (a policy reflected in the statute)
`
`so as to prevent the unjustified or improper timewise extension of the
`
`"right to exclude" granted by a patent and to prevent possible harassment
`
`by multiple assignees. See In re Goodman, 11 F.3d 1046, 29 USPQ2d
`
`2010 (Fed. Cir. 1993); In re Langi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir.
`
`1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In
`
`re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970);and, In re
`
`Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969).
`
`• A timely filed terminal disclaimer in compliance with 37 CFR 1.321 (c) may
`
`11
`
`

`

`Application/Control Number: 15/686,268
`Art Unit: 3716
`
`Page 6
`
`be used to overcome an actual or provisional rejection based on a
`
`nonstatutory double patenting ground provided the conflicting application
`
`or patent is shown to be commonly owned with this application. See 37
`
`CFR 1.130(b).
`
`• Effective January 1, 1994, a registered attorney or agent of record may
`
`sign a terminal disclaimer. A terminal disclaimer signed by the assignee
`
`must fully comply with 37 CFR 3.73(b).
`
`• Claims 1-15 are rejected under the judicially created doctrine of
`
`obviousness-type double patenting as being unpatentable over claims 1-
`
`15 of U.S. Pat. No.9,770,659. Although the conflicting claims are not
`
`identical, they are not patentably distinct from each other. Accordingly, it
`
`would have been obvious to those in possession of the invention defined
`
`by claims 1-15 to observe that the limitations described in claims 1-15 are
`
`already incorporated in claims 1-15 of U.S. Pat. No.9,770,659. Therefore,
`
`one of ordinary skill in the art would have realized that by omitting the
`
`limitations of: "the panel layout function disposes the panel selected
`
`received by the panel selection function in a target division or receives an
`
`instruction that the panel is disposed in the target division, when the panel
`
`is allowed to be displayed as an animation when being disposed in the
`
`target division" is an obvious expedient since the remaining elements
`
`perform the same functions as before. In re Karlson, 136 USPQ 184
`
`(CCPA 1963.
