`Since an abstract idea is present in the claim, the analysis continues to STPE

`STEP 28: If an abstract idea is present in the claim, it must be determined

`whether any element or combination of the elements, in the claim is sufficient to ensure

`that the claim amounts to significantly more than the abstract idea itself. In other words,

`are there other limitations in the claim that show a patent-eligible application of

`the abstract idea, e.g., more than a mere instruction to apply the abstract idea?.

`Limitations referenced in the Alice Corp. that may be enough to qualify as

`"significantly more" when recited in a claim with an abstract idea include:

`abstract idea of" displaying the panel as a moving character according to
`
`the information of motion associated with the panel when the panel is

`disposed in a target division". Accordingly, claims 1-15 are ineligible.

`• For example, claim 1 does not have "a machine" for performing the
`
`claimed functions. It is to be noted that in order to achieve the steps recite
`
`in the claims, a machine is needed. Therefore, the Applicant does not
`
`demonstrate that the claims are truly drawn to a specific apparatus distinct
`
`from other apparatus capable of performing the identical functions.

`The nonstatutory double patenting rejection is based on a judicially
`
`created doctrine grounded in public policy (a policy reflected in the statute)
`
`so as to prevent the unjustified or improper timewise extension of the

`by multiple assignees. See In re Goodman, 11 F.3d 1046, 29 USPQ2d

`nonstatutory double patenting ground provided the conflicting application

`or patent is shown to be commonly owned with this application. See 37
`
`CFR 1.130(b).

`• Effective January 1, 1994, a registered attorney or agent of record may
`
`sign a terminal disclaimer. A terminal disclaimer signed by the assignee
`
`must fully comply with 37 CFR 3.73(b).
`
`• Claims 1-15 are rejected under the judicially created doctrine of
`
`obviousness-type double patenting as being unpatentable over claims 1-
`
`15 of U.S. Pat. No.9,770,659. Although the conflicting claims are not
`
`identical, they are not patentably distinct from each other. Accordingly, it
`
`would have been obvious to those in possession of the invention defined
`
`by claims 1-15 to observe that the limitations described in claims 1-15 are
`
`already incorporated in claims 1-15 of U.S. Pat. No.9,770,659. Therefore,
`
`one of ordinary skill in the art would have realized that by omitting the
`
`limitations of: "the panel layout function disposes the panel selected
`
`received by the panel selection function in a target division or receives an
`
`instruction that the panel is disposed in the target division, when the panel
`
`is allowed to be displayed as an animation when being disposed in the
`
`target division" is an obvious expedient since the remaining elements
`
`perform the same functions as before. In re Karlson, 136 USPQ 184
