`Granting Patent Owner’s Motion for Pro Hac Vice
`Admission of John C. Scheller

`
`Patent Owner filed a motion requesting pro hac vice admission of
`John C. Scheller in the above-identified proceeding (Paper 18, “Motion”).
`We initially denied (without prejudice) this Motion because it was not
`properly supported by an Affidavit by Mr. Scheller. Paper 25. Patent
`Owner has now filed an Affidavit of Mr. John C. Scheller in Support of
`Motion for Pro Hac Vice Admission. Ex. 2013. Patent Owner’s Motion
`indicates that Petitioner was consulted and did not oppose Mr. Scheller’s
`admission. Paper 18; see also 37 C.F.R. § 42.25(a)(1). We also note that
`Patent Owner has filed an updated Mandatory Notice and a Power of
`Attorney, each referencing Mr. Scheller. Papers 27 and 28. The Board has
`reviewed the submissions and determined that the requirements of 37 C.F.R.
`§ 42.10(c) have been met and there is good cause to admit John C. Scheller
`pro hac vice.
`
`It is, therefore,
`ORDERED that Patent Owner’s Motion for pro hac vice Admission
`of John C. Scheller is granted; Mr. Scheller is authorized to represent Patent
`Owner only as back-up counsel in the above-identified proceeding;
`FURTHER ORDERED that Patent Owner is to continue to have a
`registered practitioner as lead counsel for the above-identified proceeding;
`FURTHER ORDERED that Mr. Scheller shall comply with the Office
`Patent Trial Practice Guide, as updated by the Consolidated Trial Practice
`Guide (“Consolidated Practice Guide”), available at
`https://www.uspto.gov/TrialPracticeGuideConsolidated; see also 84 Fed.
`Reg. 64,280 (Nov. 21, 2019) and the Board’s Rules of Practice for Trials, as
`set forth in Part 42 of Title 37, Code of Federal Regulations; and

`FURTHER ORDERED that Mr. Scheller is to be subject to the
`Office’s disciplinary jurisdiction under 37 C.F.R. § 11.19(a), and the

`seq.
