`argument shall proceed as scheduled.

`Patent Owner requests leave to Move for Adverse Judgment under § 42.73(b), based on mootness, given that
`this Motion was filed after the Federal Circuit appeal was dismissed. As such, the Board need not reach the
`merits of this Motion.

`Should the Board grant this request for relief, we believe that these proceedings should be terminated given that
`Petitioner's original petition is also moot based on the same grounds.
`
`Petitioner does not oppose this request.
`
`Additionally, the parties also agree that the 4/14 Oral Argument need not be held in light of Patent Owner's
`request for Adverse Judgment.
