`ColeSchotz Docket No.: 59532-0002
`
`Dear PTAB Administration:
`
`The undersigned attorneys are Counsel of Record for Patent Owner, GeigTech East Bay, LLC, in the
`above-identified two Post-Grant Review (PGR) proceedings, i.e., PGR2020-00012 and PGR2020-
`00013 (PGR12 and PGR13), between Lutron Electronics Co., Inc. (Petitioner) and GeigTech (Patent
`Owner).

`PGR2020-00012, -00013
`Ex. 3001 p. 1 of 3
`
`

`

`Petitioner filed its Petitions for PGR in both of the aforesaid PGR12 and PGR13 on December 31,
`2019. Thereafter, the United States Patent and Trademark Office (USPTO) issued Notices According
`Filing Date in both PGRs establishing a filing date of January 7, 2020 for each of PGR12 and PGR13.
`Accordingly, Patent Owner’s Preliminary Responses are due to be filed by April 7, 2020 in both
`PGR12 and PGR13.
`
`Counsel of Record for Patent Owner hereby Request that the USPTO adjust or modify the aforesaid
`due date for filing Patentee’s Preliminary Responses in each of PGR12 and PGR13, from April 7,
`2020, to and including May 7, 2020. This Request is being made pursuant to the USPTO’s Notice of
`Waiver of Patent-Related Timing Deadlines under the CARES Act (the CARE Act Notice), Provisions
`(1)(b) and (2)(a)(iii).
`
`Counsel of Record for Patent Owner hereby affirm that:

`
`The due date for filing Patent Owners Preliminary Responses in both PGR12 and PGR13
`(i.e., trial proceedings under 37 CFR §§ 42.107 and 42.207) is currently April 7, 2020,
`which falls between March 27, 2020 and April 30, 2020;
`Said due date of April 7, 2020 may be delayed with a 30-day extension of time, to and
`including May 7, 2020, due to the COVID-19 outbreak as defined in subsection (1)(b) of
`the CARES Act Notice;
`Counsel of Record for Patent Owner and Patent Owner have been personally affected
`by the COVID-19 outbreak through one or more of: office closures, cash flow
`interruption, inaccessibility of files or other materials, travel delays, personal or family
`illness, or similar circumstances, such that the outbreak is materially interfering with
`timely filing and payment in PGR12 and PGR13; and
`Accordingly, Counsel of Record for Patent Owner and Patent Owner are unable to meet
`the aforesaid patent-related timing deadline of April 7, 2020 due to the COVID-19
`outbreak, and hereby request a 30-day extension of time, to and including May 7, 2020,
`for filing the Patent Owner’s Preliminary Reponses in PGR12 and PGR13.
`
`Please acknowledge receipt and confirm the allowance of a 30-day extension of time, until and
`including May 7, 2020, for filing Patent Owner’s Preliminary Responses in both of PGR12 and PGR13.
`
`By copy of this email request, counsel for Petitioners have been notified of this Request.
`
`Thank you for your consideration and assistance.
