`Pursuant to Commission Rule 210.8(b), Complainants AutoStore Technology AS,
`
`AutoStore AS, and AutoStore System Inc. (collectively “AutoStore” or “Complainants”) submit
`
`this Statement on the Public Interest regarding the remedial orders Complainants seek against
`
`proposed respondents Ocado Group plc, Ocado Solutions Ltd., Ocado Solutions USA Inc., Ocado
`
`Innovation Ltd., Ocado Operating Ltd., and Ocado Central Services Ltd. (collectively “Ocado”),
`
`Tharsus Group Ltd. (“Tharsus”), and Printed Motor Works Ltd. (collectively “Proposed
`
`Respondents”). Complainants seek a permanent limited exclusion order under 19 U.S.C. § 1337(d)
`
`barring from entry into the United States automated storage and retrieval systems, robots, and
`
`components thereof that are manufactured abroad, sold for importation, imported, and/or sold in
`
`the United States after importation by or on behalf of the Proposed Respondents that directly or
`
`indirectly infringe one or more claims of United States Patent Nos. 10,093,525 (“the ’525 patent”),
`
`10,294,025 (“the ’025 patent”), 10,474,140 (“the ’140 patent”), 10,494,239 (the ’239 patent”), and
`
`10,696,478 (“the ’478 patent”) (collectively “the Asserted Patents”). Complainants also seek
`
`permanent cease and desist orders prohibiting Proposed Respondents, or their parents, subsidiaries,
`
`related companies, other affiliates, or agents from conducting any of the following activities in the
`
`United States: importing, selling, marketing, advertising, distributing, offering for sale,
`
`

`transferring (except for exportation), soliciting United States agents or distributors, or aiding and
`
`abetting other entities in the importation, sale for importation, sale after importation, transfer
`
`(except for exportation), or distribution of certain automated storage and retrieval systems, robots,
`
`and components thereof that infringe one or more claims of the Asserted Patents. The proposed
`
`remedies will have no meaningful impact on the public health, safety, or welfare, competitive
`
`conditions in the United States economy, or United States consumers, and there is no need for the
`
`Commission to instruct the presiding administrative law judge to take evidence and issue a
`
`recommended determination on the public interest.
`
`The accused Ocado automated storage and retrieval (“AS/RS”) systems and robots
`
`represent only a small, emerging entry into the AS/RS market in the United States. Upon
`
`information and belief, at present these products have been imported and sold to a single customer,
`
`Kroger (a significant investor in Ocado), for installation and use in future e-grocery customer
`
`fulfillment centers (“CFCs”) that were announced in May, 20181 and are presently under
`
`construction at various sites throughout the United States. The first Kroger CFC with the Ocado
`
`AS/RS system is slated to open in 2021.2
`
`In contrast, thousands of AutoStore robots are presently operating in AutoStore AS/RS
`
`systems installed in dozens of locations in the United States, serving markets as diverse as
`
`groceries, consumer electronics, automotive, healthcare and aviation. To the extent necessary,
`
`

`Complainants and other third parties can meet the demand for the accused products that would be
`
`subject to the requested remedial orders.
`
`I.
`
`THE ARTICLES SUBJECT TO THE REQUESTED REMEDIAL ORDERS ARE
`PRESENTLY IMPORTED INTO THE UNITED STATES FOR USE IN FUTURE
`E-GROCERY CFCS
`
`The accused Ocado AS/RS systems include robots, a grid system including tracks on top
`
`to allow for the movement of the robots, storage bins, a controller, and related components
`
`(including software). Proposed Respondents manufacture, import, and/or sell these systems and
`
`their components for installation and use in Kroger e-grocery CFCs that are currently under
`
`construction throughout the United States. These CFCs are scheduled to become commercially
`
`operational in 2021 and 2022.
`
`II.
`
`THE REQUESTED REMEDIAL ORDERS DO NOT RAISE SIGNIFICANT
`CONCERNS RELATING TO PUBLIC HEALTH, SAFETY, OR WELFARE
`
`The accused Ocado AS/RS systems do not implicate public health, safety or welfare in the
`
`United States to a significant degree. Complainants understand that Proposed Respondents have
`
`only a single customer in the United States, Kroger, for use in future e-grocery CFCs that are
`
`presently under construction. Although the COVID-19 pandemic has expanded demand in the e-
`
`grocery segment, there are many options for e-grocery fulfillment, and the domestic grocery
`
`industry presently conducts its e-grocery business entirely through non-accused means.
`
`III. COMPLAINANTS AND THIRD PARTIES MAKE LIKE OR DIRECTLY
`COMPETITIVE ARTICLES THAT COULD REPLACE THE SUBJECT
`ARTICLES IF THEY WERE EXCLUDED
`
`Complainants and their partners supply directly competitive AS/RS systems to various
`
`industry segments, including e-grocery fulfillment.3 There are also third party suppliers of directly
`

`competitive automated storage and retrieval systems that use different types of robots and goods
`
`storage structures to support e-commerce and e-grocery businesses. Additionally, as noted above,
`
`Proposed Respondents’ lone customer, Kroger, currently conducts the entirety of its e-grocery
`
`business through other, non-accused means.
`
`IV. COMPLAINANTS AND/OR THIRD PARTIES ARE POSITIONED TO
`REPLACE THE VOLUME OF ARTICLES SUBJECT TO THE REQUESTED
`REMEDIAL ORDERS IN A COMMERCIALLY REASONABLE TIME IN THE
`UNITED STATES
`
`Complainants and their partners have sold and continue to sell automated storage and
`
`retrieval systems, robots, and their components in the United States, including in the e-grocery
`
`sector. AutoStore has the capacity to make-up any shortfall in the United States in a commercially
`
`reasonable time. Complainants are presently unaware of any manufacturing constraints in the
`
`industry that would impede the supply of replacement products.
`
`V.
`
`THE REQUESTED REMEDIAL ORDERS WILL NOT ADVERSELY IMPACT
`U.S. CONSUMERS
`
`The requested exclusion and cease-and-desist orders will not adversely impact consumers
`
`in the United States. As explained above, there are no CFCs in the United States that are
`
`commercially using the accused products, and Proposed Respondents’ only customer conducts its
`
`e-grocery business through other, non-accused means. Further, Complainants and their partners
`
`can adequately service the United States market, and there are numerous other suppliers of AS/RS
`
`systems, robots, and components thereof that can also supply the United States market.
`
`VI. CONCLUSION
`
`The requested remedial orders raise no public interest concerns, whereas the public interest
`
`in protecting Complainants’ patent rights is strong. The accused products are imported and sold
`
`for use in future CFCs that will not be operational until 2021 and 2022, an adequate supply of
`
`alternatives to the infringing products are available, including from Complainants and their
`
`
`

`partners, as well as from third-party suppliers of automated storage and retrieval systems.
`
`Accordingly, the Commission should issue the requested remedial orders if it determines that the
`
`Proposed Respondents have violated Section 337.
