`REMARKS
`
`This reissue application is related to US Patent No. 10,766,685 (the "'685 patent"). The
`
`'685 patent is subject to concurrent PTAB proceeding 2021PGR-00085, see 37 CFR 1.178(b)).
`
`Patent Owner filed a Motion to Amend in the co-pending PGR proceedings in the PTAB. The
`
`above claim amendments for this reissue application reflect changes and additions made to the
`
`current form and numbering of the pending claims in the PGR proceedings.
`
`It is expected that prosecution of this reissue application will be suspended pending
`
`resolution of the co-pending PGR proceedings and issuance of the certificate.
`
`Status of Claims and Support for Claim Changes according to 37 CFR 1.173
`
`The issued '685 patent includes patent claims 1-48. The co-pending PGR proceeding
`
`was instituted and the Patent Owner filed a non-contingent Motion to Amend in which issued
`
`claims 1-2, 4, 7-12, 14, 19-28, 36-38, 43-48 have been canceled and substitute clams 49-68 are
`
`added (including now withdrawn substitute claims 51-53, 57, 59-60, and 66). Issued claims 3, 5-
`
`6, 13, 15-18, 29-35, and 39-42, remain unchanged by the Motion to Amend in the co-pending
`
`PGR proceedings.
`
`The reissue amendments involve changes to issued claims 3, 5-6, 13, and 15, which have
`
`been made primarily to address antecedent basis issues and/or alleged clarity issues under § 112
`
`that were brought to light in the co-pending PGR proceedings. The reissue amendments also
`
`include new claims 69-77 which are broadening claims directed to a method of preparing a
`
`transport container with a thermally insulated interior for holding temperature sensitive goods
`
`within a defined temperature range.
`
`Claims that were instituted in the co-pending PGR proceedings and have corresponding
`
`proposed substitute claims as set forth in the "Substitute Appendix A - Listing of the Claims" in
`
`the co-pending PGR proceedings (as set forth in the "Substitute Appendix A - Listing of Claims"
`
`filed with Paper 22 of the above-noted proceeding 2021PGR-00085, which is filed herewith as
`
`Exhibit C) are identified as "canceled in PGR" in this reissue amendment. Substitute claims
`
`added in the co-pending PGR proceedings are identified as "substitute claim in PGR." It is noted

`In an attempt to conform with 37 CRF 1.173 and MPEP 1453 VI. (B), the underlining and
`
`brackets treat the claims in the "Substitute Appendix A - Listing of the Claims" as if they are
`
`allowed and presented in a certificate after the PGR concludes in the same form as in the
`
`"Substitute Appendix A - Listing of the Claims".
`
`For reference, Applicant has filed herewith the "Substitute Appendix A - Listing of
`
`Claims" filed in the above-noted PGR including substitute claims 49-68 having redline
`
`amendments which emphasizes the difference between the text of substitute claims and the
`
`corresponding original issued claim on which the substitute claims is based.
`
`The claims are fully supported by the disclosure. The below Table 1 provides explanations
`
`to support the currently amended claims and new claims in accordance with 37 CFR 1.173( c ). A
`
`similar table for claims 49-69 was filed in the above-noted PGR (see Paper 13 of the above-noted
`
`proceeding 2021PGR-00085, filed herewith as Exhibit A) and was acceptable to the Board as
`
`identifying sufficient written description support (see Paper 19 of the above-noted proceeding
