throbber
I, Martin Weinberger, hereby declare as follows:
`
`1.
`
`I am over the age of 18 and have personal knowledge of each of the
`
`matters set forth in this declaration, and if called as a witness, would testify
`
`competently to them.
`
`2.
`
`I am an employee of NXP Semiconductors Austria GmbH (“NXP”). I
`
`have worked for NXP since June 2006. My current position is Technical Program
`
`Manager, and my previous positions at NXP include Principal Engineer and Senior
`
`Development Engineer. My responsibilities as Technical Project Manager include
`
`planning projects, scheduling and delegating tasks, monitoring and executing
`
`various project phases, managing budgets, and communicating with stakeholders,
`
`among others.
`
`3.
`
`I am writing this declaration (i) to describe how I received samples of
`
`the Monza R6 chip in May 2014 at a radio frequency identification (RFID)
`
`industry event held by the company Mühlbauer, and (ii) to address whether the
`
`Monza R6 chip samples that I received in May 2014 are the same as the chips
`
`described in Impinj’s Monza R6 Tag Chip Datasheet and in a Monza R6 circuit
`
`analysis report produced by Science Vision, Inc. (“Science Vision”). I address
`
`these topics in the paragraphs that follow.
`
`4.
`
`Mühlbauer is a manufacturer of products for the RFID and
`
`semiconductor industries headquartered in Roding, Germany. Mühlbauer is a

`
`

`

`leading global manufacturer in these industries with technology centers in
`
`Germany, Malaysia, Slovakia, the United States of America, and Serbia, and over
`
`thirty sales and service locations worldwide. In 2014, Mühlbauer invited the
`
`RFID community to explore future technologies at its “RFID Innovation Days”
`
`event, which was held at its company headquarters in Roding, Germany, from
`
`May 25-28, 2014. I attended the RFID Innovation Days event in May 2014.
`
`5. Mühlbauer widely advertised the RFID Innovation Days event and
`
`invited the RFID community to attend. For example, the website Label & Narrow
`
`Web (www.labelandnarrowweb.com) published the following invitation in its
`
`“Industry News” section:

`
`the invitation bears the date April 15, 2014. The invitation was still available as of
`
`October 6, 2021, when I last accessed it.
`
`6.
`
`Label & Narrow Web is a well-known website and print publication
`
`that serves the packaging community. It advertises itself as the “premier resource”
`
`for those in the packaging field and provides information on packaging
`
`technologies like RFID. See https://www.labelandnarrowweb.com/about-us/
`
`(“With there being such a rapid pace of change within the industry, in order to stay

`

`on top, it’s imperative for label converters to stay informed on the latest trends and
`
`technologies, new products, as well as industry happenings. This is where Label &
`
`Narrow Web comes in. For 23 years, L&NW has been the premier resource for
`
`label professionals, as well as those in the branding and packaging fields who want
`
`to understand the nuances behind all that goes into label manufacturing. Label &
`
`Narrow Web – both in print and online – are additional tools in a converter’s
`
`arsenal. L&NW serves as a means for gathering the latest information on emerging
`
`technologies, developing markets and news regarding both converters and
`
`suppliers alike. Industry professionals ranging from press operators to CEO’s can
`
`benefit from L&NW.”).
`
`7. Mühlbauer’s RFID Innovation Days was also advertised on the
`
`website Labels & Labeling (www.labelsandlabeling.com). Specifically, the event
`
`was advertised in the website’s “Industry Updates” section, with the posted
`
`invitation describing Mühlbauer’s new “direct die attach” technology and inviting
`
`readers to follow a link to register:

`
`8.
`
`As seen above, the invitation on the Label & Labeling website bears
`
`the date May 2, 2014, and states that “[t]he event features two conference

`
`stakeholders from the RFID smart label industry engaged in system manufacturing
`
`development, partnership building, technology transfer and innovation.”
`
`9. Mühlbauer’s RFID Innovation Days was also advertised on the
`
`website Ink World Magazine (www.inkworldmagazine.com). The event was
`
`advertised on the website’s breaking news section, which stated that “Mühlbauer

`
`of October 6, 2021, when I last accessed it.
`
`10. As seen above, the invitation on the Ink World Magazine website
`
`bears the date March 14, 2014, and states that “[t]he event features a
`
`comprehensive conference program with Mühlbauer’s automation experts. In

`
`11.
`
`I attended the RFID Innovation Days event in May 2014. It was well-
`
`attended. A photo showing some of the event’s attendees was taken:
`
`12.
`
`I received this photo from Mühlbauer after the event. I am pictured in
`
`the photo, as indicated by the red oval below:

`
`

`

`
`
`13. NXP was a “Gold Sponsor” of the RFID Innovation Days event, as
`
`was Impinj. Attached as Appendix A is a true and correct copy of an email from
`
`Werner Plötz (“Business Development, Semiconductor Related Products”) of
`
`Mühlbauer. NXP received this email on April 1, 2014. As seen in the email,
`
`Mr. Plötz thanks NXP and Impinj for their sponsorship of the event, and also states
`
`that the companies Delo, Nippon Chemical and Voyantic were sponsors. DELO
`
`advertises itself as the world’s leading manufacturer of RFID adhesive solutions.
`
`Nippon Chemical manufactures chemical products for RFID applications.
`
`Voyantic advertises itself as the leading global provider of RFID testing and
`
`measurement solutions.
`
`14. Mr. Plötz’s email (see Appendix A) states that NXP and Impinj were
`
`to deliver speeches at the event and also have their “UHF products … run through
`
`the Direct Die Attach [DDA].” The Direct Die Attach system from Mühlbauer

`
`

`

`enables integrated circuits (also referred to as “dies”) to be attached to antennas,
`
`such as etched aluminum antennas on polyethylene terephthalate (PET) substrates.
`
`As is further seen in Mr. Plötz’s email (Appendix A), Mühlbauer’s new
`
`personalization equipment “PL 60000” was to be demonstrated at the event.
`
`15. Attached as Appendix B is a true and correct copy of a slide deck
`
`from Mühlbauer describing the PL 60000 and other equipment. As seen in
`
`Appendix B, the PL 60000 is a dedicated high-speed system for UHF encoding:
`
`Appendix B at 10. The PL 60000 includes Impinj’s STP Source Tagging Platform
`
`(Appendix B at 11-12) and can be used to encode the Impinj Monza R6 chip:

`
`16. At the May 2014 RFID Innovation Days event, Impinj presented its
`
`new Monza R6 product as part of Mühlbauer’s demonstration of the PL 60000
`
`equipment. This can be seen in Appendix C, which is a true and correct copy of a
`
`final agenda for the RFID Innovation Days event. NXP received this final agenda
`
`in an attachment to an email from Werner Plötz on April 11, 2014. The final
`
`agenda shows that on May 27, 2014, representatives from Impinj were to present
`
`as part of the PL 60000 demonstration:

`Appendix C at 7.
`
`17. At the PL 60000 demonstration, I received samples of the Monza R6
`
`chip. Specifically, there was a roll of Monza R6 samples at the PL 60000
`
`demonstration, and attendees took samples from the roll. In receiving the Monza
`
`R6 samples, I was not under any obligation of confidentiality, and no restrictions
`
`were placed on recipients’ use of the samples. Impinj’s distribution of samples of
`
`the Monza R6 chip at the RFID Innovation Days event in May 2014 is consistent
`
`with Impinj’s press releases from this time period. Attached as Appendix D is a
`
`true and correct copy of an Impinj press release dated April 2, 2014, where Impinj
`
`states that “Monza R6 chip samples are available now.”
`
`18. NXP took photos of the Monza R6 samples that I received at the
`
`May 2014 event. Two of the photos show a Monza R6 chip sample after
`
`decapping, which is the process of removing the protective cover of the integrated
`
`circuit:

`
`received in May 2014. Attached as Appendix E is a true and correct copy of a
`
`document describing NXP’s analysis of the Monza R6 samples. It is entitled
`
`“Impinj Monza R6 Analysis” and dated June 17, 2014. The document captures
`
`results of NXP’s testing of the Monza R6 chip.

`

`23.
`
`I have reviewed the Impinj Monza R6 Tag Chip Datasheet (“R6
`
`Datasheet”) and Science Vision Circuit Analysis Report
`
` – Monza R6
`
`Tag Chip (“R6 Circuit Report”), which are attached as Appendices F and G to this
`
`declaration, respectively. It is my opinion that the R6 Datasheet and the R6 Circuit
`
`Report are describing chips that are the same as the Monza R6 samples that I
`
`received in May 2014.
`
`24. Both the R6 Datasheet and the R6 Circuit Report describe a chip that
`
`is named “Monza R6.” See Appendices F and G. That is the name of the chip that
`
`I received at the May 2014 Innovation Days event. As seen in Appendix E, the
`
`sample chip that I received in May 2014 and that NXP subsequently tested in June
`
`2014 is named “Monza R6”:
`
`
`
`Appendix E at 1, 4. The left image states “Impinj Monza R6 Analysis,” and
`
`includes the date June 17, 2014. The right image states: “IC: Impinj R6.” Impinj’s
`
`distribution of the Monza R6 samples at the May 2014 Innovation Days event is
`
`
`
`- 17 -
`
`
`
`NXP EX 1006
`NXP v. Impinj
`
`

`

`consistent with Impinj’s April 2014 press release stating that “Monza R6 chip
`
`samples are available now.” Appendix D.
`
`25. Further, the R6 Datasheet describes a chip having 5-step autotuning.
`
`Appendix F at 14 (“AutoTune value represents the tuning capacitance scale, from
`
`zero to four.”), 15 (showing changes in capacitance values for five different
`
`autotune values). As seen in Appendix E, the sample Monza R6 chips that I
`
`received in May 2014 and that NXP tested in June 2014 likewise had 5-step
`
`autotuning:
`
`Appendix E at 2, 18. The left image states “5 Step auto-tuning confirmed,” and the
`
`right image states “5 Step auto-tuning confirmed by lab measurements.”
`
`26. The R6 Datasheet and the R6 Circuit Report describe that the Monza
`
`R6 is an ultra-high frequency (UHF) RFID IC. For example, the R6 Datasheet at
`
`page i states that “Monza® R6 [is a] UHF RFID chip,” and page 11 indicates that
`
`the chip is designed for a frequency range of 860-960 MHz. As seen in
`
`
`
`- 18 -
`
`
`
`NXP EX 1006
`NXP v. Impinj
`
`

`

`Appendix E at pages 7-12, 14 and 15, the sample Monza R6 chips that I received
`
`in May 2014 operated in this UHF frequency range, e.g.:
`
`Appendix E at 7,
`
`
`
`27. The R6 Circuit Report (Appendix G) describes at pages 7 and 9
`
`
`
`
`
`Appendix G at 9.
`
`28. The measured size of the Monza R6 chip samples I received in May
`
`2014 is nearly identical. As shown in Appendix E at page 2,
`
`
`
`
`
`
`
`
`
`- 19 -
`
`
`
`NXP EX 1006

`

`Appendix E at 2, stating that
`
`29. The R6 Datasheet (Appendix F) states at page 7 that
`
`
`
` The
`
`
`
`
`
`discrepancy is small, and I presume that the datasheet is slightly inaccurate because
`
`NXP’s measurement is nearly identical to that of the R6 Circuit Report
`
`(Appendix G) produced by Science Vision. Science Vision is a semiconductor
`
`reverse-engineering company that specializes in IC teardown, imaging, and
`
`analysis. Determining the area of a chip requires only basic measurement
`
`equipment and analysis skills, and I presume that a company like Science Vision
`
`would be well equipped to accurately measure the size of the Monza R6 chip.
