`AFFIDAVIT
`
`COMMONWEALTH OF PENNSYLVANIA
`
`COUNTY OF ALLEGHENY
`
`VVV
`
`SS:
`
`AND NOW COMES the undersigned Affiant, Elwood Gaither, who, being ofproper age and
`duly sworn, states the following:
`
`I
`
`PLAIN'HFF’S
`XHI
`
`1.
`
`2.
`
`3.
`
`4.
`
`5.
`
`6.
`
`My name is Elwood Gaither and I live at 7049 Bennett Street, Pittsburgh, PA
`1 5208.
`
`I have been employed as a 449 steamfitter here 1972 until the present. I have not
`worked since April 14, 2011 due to my cancer diagnosis.
`
`I have never smoked cigarettes and I only started occasionally smoking a cigar
`within the last ten years. I do not inhale when I smoke the occasional cigar. My
`doctors have told me that the cigars did not cause my lung cancer.
`
`I was exposed to asbestos throughout my career in a variety of different jobs at
`many different facilities. This afifidavit does not list all of my exposures, but only
`the ones that I can remember as of now. Since I have been told that my
`deposition is coming up, Ihave tried to remember as many exposures as I can.
`The more and more I think about my career, the more I am able to remember. I
`am able to provide the name of some products at some locations, but for other
`products, I am able to testify about my use of the product, but I am not able to
`give a location.
`
`Steamfitters routinely work on valves, pumps and other equipment essaafial to
`piping. I have been exposed to asbestos from the work that [have done on the
`following equipment dozens of times from the early 19705 until the mid to late
`19805. To remove packing we would use a packing hook. This could take
`minutes or over an hour. We removed gaskets fiom the bonnet, the inside ofthe
`pump housing, and the flange with a wire brush, sometimes electric, sometimes
`hand held.
`
`I have been exposed to asbestos gaskets and packing floor the following valves.
`The gaskets were both on the flange and in the bonnet. The packing was inside
`the packing stem. Each of these companies supplied their own asbestos gaskets
`and packing at times. Other times, we used generic gaskets and packing.
`I _
`worked on the following valves dozens of times each, which exposed me to
`asbestos on each of those occasions:
`
`

`

`
`
`Cashco valves
`
`DeZurik valves
`Gn‘nnell valves
`
`Honeywell valves
`Crane valves
`
`Yarway valves
`Powell valves
`Milwaukee valves
`ITT valves
`
`Stockham valves
`
`
`
`“-m-H‘P‘snthe21.09'?
`
`I have been exposed to asbestos gaskets from the following steam traps. Each of
`these companies supplied their own asbestos gaskets at times. Other times, we
`used generic gaskets. I worked on the following steam traps dozens of times
`each, which exposed me to asbestos on each of those occasions:
`
`a. Armstrong
`b. Yarway
`c. Sarco
`
`I have been exposed to asbestos gaskets and packing from the following pumps.
`The gaskets were both on the flange and in the bonnet. The packing was inside
`the impellor. Each of these companiessupplied their own asbestos gaskets and
`packing at times. Other times, we used generic gaskets and packing. I worked on
`the following pumps dozens of times each, which exposed me to asbestos on each
`of those occasions:
`
`a. Goulds pumps
`DeLaval pumps
`Nagle pumps
`Ingersoll—Rand
`Buffalo Pumps
`BIaclcmer Pumps
`Armstrong pumps
`Durco pumps
`Dean pumps
`Peerless pumps
`Bell & Gossett pumps
`Aurora Pumps
`
`
`
`Pa‘v'r's‘qarm:19P‘
`
`In. Byron Jackson
`
`I have worked with Black Magic Cerbomndum grinding wheels to sharpen '
`tungsten. I have used other carborundum grinding wheels.
`
`

`

`
`
`10.
`
`11.
`
`12.
`
`13.
`
`14.
`
`15.
`
`16.
`
`17.
`
`I know that Pittsburgh Gage, Plotkin Brothers, George V. Hamilton and PB.
`Wright supplied asbestos products to many of my jobsites. I would see these
`suppliers delivering asbestos cloth, gaskets, packing and tools to many, many of
`the jobsites that I worked at over the years.
`
`I worked on Copes Vulcan soot blowers at Keystone Power Station and Cheswick
`Power Station. I was exposed to asbestos whenl changed out the packing in the
`poppet valves.
`
`I was exposed to asbestos on the coke batteries at USX Clairton and at J&L Steel.
`I was exposed to the rope packing on the doors of the coke ovens as well as the
`insulation on the pipes.
`
`I was exposed to United Conveyor Ash Handling equipment at Keystone Power
`Station. The plant workers used asbestos cement as seals on the equipment in my
`presence. They would mix the cement with water in a bucket and I breathed in
`dust when they dumped the cement.
`
`I have worked around air compressors manufactured by Ingersoll Rand and Joy
`that were being installed. This work exposed me to asbestos as they used gaskets.
`
`I have worked around other outside contractors while at many of my various
`jobsites. Their work at these jobsites
`
`- I have worked around Atlas, Dravo, Minnotte and McCarl‘s when they
`were ripping out asbestos pipe covering and gaskets when removing
`piping-
`
`. I worked around Eichleay as they tore out the blast finance.
`
`- I was exposed to asbestos from Foster Wheeler employees when they
`worked on their boiler at Bruce Mansfield Power Station
`
`- I worked around employees for Power Piping who exposed me to
`asbestos at various jobsites, including US Steel Clairton.
`
`I worked around the pouring of steel in the open hearth of 1&L South Side works
`in 1973 for about six months.
`
`When I worked at the different power stations and steel mills during the 19705
`and through the mid-19805, there were no warnings regarding the hazards of
`asbestos. At each of these facilities, the employees of the premises owner
`‘
`continued to perform their work in my presence, exposing me to different
`asbestos containing products.
`
`

`

`
`
`18.
`
`As a steamfitter apprentice, Ihad six months of class room training for five years,
`as well as on the job training. We learned about the various piping systems,
`valves, pumps, etc. We learned about the use of asbestos on steamlines. Because
`so much of what we had to do involved steam, we always used asbestos gaskets
`and packing. That is what was necessary on steamlines, and so as to avoid an
`accident, we only carried asbestos gaskets and packing. Ifwe had to replace a
`gasket or packing frorn a valve on a cold water line or water pump, we would still
`use asbestos. The above described gaskets and packing all contained asbestos
`until the mid to late 19305.
`
`19.
`
`This Affidavit is made subject to the penalties of 18 Pa.C.S. § 4904 relating to
`unsworn falsification to authorities.
