`AND NOW COME the above-captioned Plaintiffs, by and through their counsel, Motley
`
`Rice, LLC and Goldberg, Persky & White, PC, and file the following Pretrial Statement:

`PLAINTIFFS’ PROPOSED VOIR DIRE STATEMENTS

`
`We have the honor of representing David Zalewsky and his Wife Cheryl.
`
`We are here today because in 2015 Mr. Zalewsky was diagnosed with mesothelioma. David’s
`mesothelioma was caused by the Defendants who are present in this Courtroom. These companies
`are on trial for exposing Mr. Zalewsky to asbestos.
`
`We will show you that these companies knew of the horrific and deadly effects of asbestos dust
`exposure and did nothing to protect David. We Will call to the stand Mr. Zalewsky and his wife,
`as well as expert witnesses, who will all describe this untimely tragedy. Then, we Will ask you to
`render a monetary verdict in favor David and Cheryl Zalewsky.
`
`PLAINTIFFS’ PROPOSED VOIR DIRE QUESTIONS

`enjoyment of life to someone who was injured by a product?

`only certain live witnesses identified below and has no obligation to call all listed Witnesses.

`*EXPERT WITNESSES AND REPORTS
`
`Both medical and non—medical expert Witness information has previously been supplied to
`Defendants pursuant to the Case Management Order. The following expert witnesses have
`provided reports and may be called upon to provide testimony regarding the treatment of the
`individual decedent’s disease. Plaintiff reserves the right to call any expert witnesses whose
`reports have been submitted in this case. Plaintiff reserves the right to call any witness listed on
`any other expert witness list filed in this action. Plaintiff may additionally call as a Witness any
`Records Custodian at any facility at which David Zalewsky was diagnosed With or treated for
`Mesothelioma. The Plaintiffs reserve the right to amend, modify or supplement this Expert
`Designation if additional information is discovered or if inadvertent errors or omissions.
`
`Jerrold L. Abraham, M.D. — Narrative Reports dated 10/06/16 and 1/04/17: General medicine
`and pulmonary pathology. Dr. Abraham will testify as to the pathological diagnosis of asbestosis
`and Mesothelioma. He will testify as to the relationship between asbestos and mesothelioma. He
`will offer opinions on the cause of the disease suffered by the plaintiff. Plaintiffs also incorporate
`their prior disclosure.
`
`UPMC of St. Margaret Pathology Report 11/9/15 — or other medical reports for David
`Zalewsky.
`
`Christopher DePasquale, MPH, CIH— Report dated 10/31/16. Mr. DePasquale will testify
`regarding the evaluation of asbestos-containing materials, material-testing techniques, bulk
`sampling, air-sampling techniques, fiber—counting techniques, the techniques of measuring the
`releasability of fibers, and the migration, re—entrainment and drift of asbestos fibers in the
`workplace. Mr. DePasquale may also testify regarding the releasability of asbestos fibers from
`defendants' products that will be at issue in this case. Plaintiffs also incorporate their prior
`disclosure.
`
`Donal F. Kirwan—Report dated 10/13/16: Mr. Kirwan will testify regarding the economic loss
`attributable to the Plaintiff’ s mesothelioma. Plaintiffs also incorporate their prior disclosure.
`

`Arnold R. Brody, Ph.D. - Dr. Brody will testify about the mechanics of asbestos disease including
`the development of fibrosis and cancer, animal research with asbestos, molecular biology, the
`patho—microscopic development of mesothelioma, asbestos fiber types and the propensity of
`various fibers to cause disease.
`
`Dr. Brody is expected to testify regarding the physiological design and function of the lungs, the
`disposition and migration of asbestos fibers in and throughout the body, the effect of asbestos on
`the lungs and other parts of the body, as well as on the body's defense mechanisms. He may also
`testify concerning biological and toxicological effects of asbestos as evidenced by his research, as
`to biological responses to all exposures to asbestos, effects produced by all fiber types and
`mechanisms of asbestos—induced diseases. Dr. Brody will testify that all of the asbestos fiber types
`are complete carcinogens and that all forms of asbestos, including chrysotile, can cause asbestosis,
`lung cancer and mesothelioma, and various other cancers, and that asbestos alone is capable of
`inducing the genetic errors that can lead to cancer.
`
`Dr. Brody will testify that epidemiology has shown that asbestos-exposed individuals who
`smoke are more likely to develop a lung cancer than those who only smoke. He will testify that
`cigarette smoking has no apparent influence on the development of malignant mesothelioma and
`that the only established environmental cause of this cancer in North America is exposure to
`asbestos.
`
`Dr. Brody will testify that some studies at autopsy found a preferential accumulation of
`chrysotile fibers in pleural and mesotheliomatous tissues and that mesotheliomas are caused by
`cumulative exposures. Dr. Brody will testify that, similar to lung cancer, the latencies before
`clinical manifestation of mesothelioma are 10 to 50 years or more, and that even though
`mesothelioma is a dose-responsive disease, it has been shown to develop in susceptible individuals
`with brief exposures, such as children, and that no safe threshold level of exposure to asbestos has
`been determined for mesothelioma. Plaintiffs also incorporate their prior disclosure.
`
`Dr. Gerald Markowitz- Report and Chronology - Dr. Markowitz will testify about his review of
`corporate documents and information that was made available to the defendants in regards to the
`hazards associated with asbestos exposure. Dr. Markowitz will also testify regarding state-of-the-
`art documents and the medical and scientific literature as it relates to the health hazards caused by
`asbestos exposure.
`
`Dr. Markowitz will also testify as to various trade associations and the knowledge that was
`made available to their members,
`including industry-sponsored research on asbestos,
`the
`fraudulent actions and inactions of the defendants and actions taken by industry members to
`influence regulators and legislators. Dr. Markowitz will testify about the advertising and
`promotional campaigns of the industry associations and the defendants, and will testify about
`misrepresentations made by them and will also testify about asbestos substitutes and alternatives.
`Dr. Markowitz will testify about the conspiracy by the defendants to conceal knowledge of the
`hazards of their products that contained asbestos. Plaintiffs also incorporate their prior disclosure.
`
