`
`Opposition No. 91155965
`
`Serial N0. 76388837
`
`June 29, 2003
`
`Preliminary Response to Opposition by
`Schering-Plough Healthcare Products
`
`Now comes Dr. Mitchell Swartz,
`
`for BUG-SUN TECHNOLOGIES, with the
`
`following reasons given for this pleading.
`
`Schering-Plough‘s opposition is unjust and unfair.
`
`1. Dr. Swartz was the first to use the derivative of the mark, SUN-BUG, and
`
`thereafter BUG-SUN TECHNOLOGIES. This is shown in Exhibit 1 (attached).
`
`2. Schering-Plough Healthcare Products is not damaged by the present mark.
`
`3. On information and belief, some of Schering-Plough Healthcare Products
`
`statements in their Opposition are not accurate.
`
`

`
`
`
`;.
`
`4. Schering-Plough Healthcare Products has not used good faith conduct.
`
`5. Schering-Plough Healthcare Products has a history of harassing, and usurping
`technology from, Dr. Swartz.
`The above—action was filed immediately after, and in
`
`response to, Dr. Swartz filing of a Petition for Certiorari against the Opposer regarding
`ongoing litigation involving Opposer usurping Dr. Swartz's technology and brand
`name [Exhibit 1 (attached)].
`
`6. Dr. Swartz reserves the right to provide additional reasons to oppose after
`consultation with counsel.
`
`7. The U.S. Supreme Court has ruled that any pro se litigant is entitled to less
`
`stringent standards [US Rep volume 404, pages 520-521 (1972)].
`
`Respectfully submitted,
`

`
`Motion to Enter Opposition Late
`
`Now comes Dr. Mitchell Swartz,
`
`for BUG-SUN TECHNOLOGIES, with the
`
`following reasons given for this reasonable Motion.
`
`1. The filing of the Response to their Opposition was missed inadvertently and
`
`unintentionally.
`
`2. Furthermore, Dr. Swartz informed Ms. Latricia Harrison, Legal Assistant of his
`
`opposition, and was not aware a further answer was required at this time.
`
`3. Dr. Swartz has been unable to find counsel at this time to answer the Opposition.
`
`The U.S. Supreme Court has ruled that any pro se litigant is entitled to less stringent
`standards [U.S. Rep volume 404, pages 520-521 (1972)].
`
`4. Schering-Plough Healthcare Products has not used good conduct.
`
`

`
`
`
`=3
`
`5. Schering-Plough Healthcare Products never sent to copy of the complaint to Dr.
`Swartz. Ms. Latricia Harrison, Legal Assistant to the Board, did send a facimile copy,
`however, a complete scan-legible copy was again requested, but so far not received.
`
`6. On information and belief, Schering-Plough Healthcare Products has had
`
`opportunity to extend their own time to meet the deadline.
`
`For the above reasons, it is requested that this reasonable Motion be allowed.
`
`Respectfully submitted,
